12. dead sugar maple tree must be replaced between 2109 and 2105 Albemarle

The city will go out and identify the trees that have not been planted or have died, and
require the builder to replace or plant them.

3. Other Concerns:

A. Retention Pond

1. The retention pond, in it's present condition, is unsightly. The incline is too
steep to mow and the grass seed has not germinated. There is an abundance of
weeds.

The city checked the grade of the pond and claims that the elevation is within the
requirements. It had to be designed and signed off on by a Civil Engineer. The
builder does not like the looks of it either. He is examining the seeding.

2. Because of the steep incline and the depth, it is potentially dangerous.

The city or the builder is not responsible to put up railings or safety devices.

B. Power for Irrigation System

1. The builder has hooked up power for the irrigation system to 2112 Albemarle
and has advised the Townhome Association that they are required to pay the
homeowner for electricity. The builder has said that they "were told verbally
and in writing to complete the system this way." We cannot determine who
told him to do it that way. Would it be within the purview of the City? This
arrangement is unacceptable to the Townhome Association. The Association
wants the irrigation meter to be installed on the south side of the sprinkler house.

The city would not have gotten involved in this. It would have been NSP. The
Association could contact NSP and have the electricity installed with a separate
meter.

c. Water shutoffs

1. There is controversy over whether the water shutoffs are within the City
specifications regarding height.

The city will inspect. They thought that the builder might be waiting for final
landscaping. The shutoffs have a 12-16" sleeve that can be adjusted.

D. Exterior of Buildings
