It is obvious that the Oval scoreboard is a very complex me~sage board which <br />can flash scores, messages, advertising" etc., to the captured audience inside the facility. (On a <br />smaller scale, the new Bar-Mar message tower inside the mall can do the same thing. No permit <br />was required) <br /> <br />Section 14.030, "Advertising Signs Prohibited" states that such signs are not allowed in any <br />district within the City. The staff maintains that the Oval scoreboard signs and proposed signagc <br />on wind screens, etc., are within an enclosed facility, displaying and directing their messages to <br />the "captured audience". They are not "advertising signs" by definition because they do not. <br />purposefully direct and display their message to the off-site public right-of-way, vehicular and <br />pedeSUiantraflac. .' <br /> <br />Section 14.040, "Flashing Signs Prohibited" states that such signs are not allowed in any district. <br />Again, the Oval application is inside of a permitted facility. directed to captured audience; not too <br />much different from the old Metropolitan or the St. Paul Saint's stadium scoreboard and <br />animation. I'm sure there wU no sign permit in that instance, either. <br /> <br />Section 14.220. "Prohibited Signs" states that illuminated signs and others listed in the General <br />Provisions are prohibited ftom residential districts. The City Civic Center site is located within a <br />residential zone, however. none of the interior Oval (or ice arena) signs are directed to the public. <br /> <br />Recommendations: <br />Steve, I think it is clear and logical why no permits are necessary. However. if there is still <br />misunderstanding about the sign code interpretation, there are a number of solutions: <br /> <br />1) The Oval Thrector could request an appeal and official interpretation/decision ofthc <br />City Council. ' <br /> <br />2) The Oval Director could request a variance fi'om the City Council. <br /> <br />3) The City could rezone the entire Civic Center site. subject to a master plan, to a PUD <br />with specific sign criteria. <br /> <br />4) The sign code could be amended to clearly define an "interior sign" and state that <br />interior signs !lte not regulated by the Sign Code. Additionally, an amendment could <br />specify what types and sizes of signs are permitted with (and without) permits on all types <br />of public property (State. County.
