4.2 The applicant has demonstrated the service area for the proposed antennas. 4.3 The property owner will bring the building into compliance with the fire and building code prior to issuance of conditional use and building permits. 4.4 In reviewing this request, staff made the following findings: 1. The proposed expanded use of the property for a professional office building with cellular telephone antennas will have a minimum impact on traffic in the area. Any additional traffic generated by the expanded use for antennas will be minimal. 2. The proposed expanded use of the property for cellular telephone antennas will have a minimum impact on parks, streets, and other public facilities. 3. The proposed expanded use of the property for cellular telephone antennas will be compatible with contiguous properties. Other buildings in the immediate area are limited to three stories or less, while this building is six stories in height. The antennas will be located on the top of the penthouse and will create a minimal impact on adjacent properties. The antennas must be visible in order to function properly without "shadowing." 4. The proposed expanded use of the property will not have an adverse impact on the market value of contiguous properties. 5. The proposed expanded use of the property will not have an adverse impact on the general public health, safety and welfare. The installation of essential public communications equipment is recognized as a necessity within the community. In addition, the antennas will operate in the 1.9 to 2.2 Ghz radio frequency range, transmitting and receiving a low power wireless radio signal to a small service cell (.75 to 1.0 mile radius). 6. The proposed expanded use is consistent with the City's Comprehensive Plan's Limited Business designation and City policies regarding personal communication system antennas. M STAFF RECOMMENDATION 5.1 The staff recommends approval only if three items are included: A. Technical justification for penthouse roof mounted and visible placement as compared to use of existing towers or architecturally integrated antennas. B. Delineation of the service areas of the proposed antennas. C. The building owner must bring the building into compliance with the building life safety codes by constructing rated corridors prior to receiving any additional permits.
