Indianhead never loads or unloads a customer's products at the

Property. In fact, the Property is not adjacent to any railroad, tank, pipeline or waterway from

which anything could be loaded or unloaded. I have attached as Exhibit 24 a rough site plan

depicting the Property. Because no loading or unloading occurs at the Property, each truck

and trailer parked at the Property must be taken elsewhere to be loaded and unloaded.

18. In fact, a customer's product virtually never even comes onto the

Property. The only time a customer's product is on the Property is the exceptional $ituation

where a loaded truck may be unable to make a delivery until the following day and must be

parked overnight with the customer's product loaded on board. I would estimate that this

occurs from zero to 12 times per year.

19. The only impact that Indianhead' s operations has on the neighborhood

is the daily coming and going of truck-trailer rigs. Indianhead equipment on average enters

and exits the Property about 36 times (about 18 round trips) daily. At our peak business

period, equipment entered and exited the Property more than 100 times (more than 50 round

trips) daily.

20. The only fuel stored at the Property consists of a small diesel fuel tank
which Indianhead uses to refuel its trucks. The diesel fuel tank holds 10,000 gallons of diesel
fuel, which is barely more than the amount of fuel that can be transported in a single tank

5
