2.3 It is the intent of the applicant to demolish the play area and create open space for
the multi-family residential use. Additional four-plexes may be constructed in the
future, although the timing and location of such construction has not yet been
determined.

2.4 The proposed reconstruction of the McDonald's restaurant will require a conditional
use permit, which will include a separate public hearing before the Planning
Commission and action by the City Council.

2.5 Section 1015 of the City Code outlines the procedure for amending the zoning code
and the official zoning map.

3.0 STAFF COMMENT

3.1 In reviewing this request, staff has made the following findings:

1. The City's Comprehensive Plan map designates the entire parcel located at
2075 Snelling Avenue North as Business and the entire parcel located at
2096 Fry Street North as High Density Residential.

2. The City's Comprehensive Plan text does not specifically address this parcel;
however, it is the policy of the City to discourage the encroachment of
commercial uses into residential neighborhoods. The transfer of the west .54
acres of the McDonald's parcel to the adjacent multi-family parcel, along with
the designation of the .54 acres as high density residential and the rezoning
of the parcel to R3A, will remove the commercial encroachment into a
residential area.

3. A minor subdivision to transfer this property from 2075 Snelling Avenue
North (McDonald's - land owned by applicant) to 2096 Fry Street North (four-
plexes - land owned by applicant) was approved by the City Council on
September 8, 1997, subject to approval of a comprehensive plan
amendment and rezoning of the parcel.

4. A request for a comprehensive plan amendment to change the designation
of this parcel from Business to High Density Residential was approved by the
City Council on January 12, 1998, subject to Metropolitan Council review and
comment.

5. The proposed rezoning is in harmony with the general purpose and intent of
the City's Comprehensive Plan and Title 10 of the City Code (Zoning).

6. The proposed rezoning will not adversely affect the public health, safety, or
general welfare.

PF#2958 - RCA (01/26/98) - Page 2 of 3
