<br />DEVELOPER shall not be required to dedicate land or make a payment in lieu in <br />conjunction with plat approval, since the previously developed property is being <br />reconfigured and no additional buildable lots are being created. <br /> <br />9.0 Site Development Requirements and Subdivision Standards <br /> <br />To ensure that the proposed development meets the CITY'S requirements and standards <br />tor site development, the tollowing provisions shall apply: <br /> <br />9.1 Final Grading Plan. The final grading plan tor Lot 1 must be reviewed and approved <br />by the Director of Public Works prior to any permits being issued for this building <br />pad. The final grading plan for Lot 3 must be reviewed and approved by the Director <br />of Public Works prior to any permits being issued for this building pad. All grading <br />shall comply with the approved grading plans and shall be the responsibility ot the <br />DEVELOPER. <br /> <br />9.2 Final Utility Servicing Plan. The final utility servicing plan for Lot 1 must be reviewed <br />and approved by the Director ot Public Works prior to any permits being issued for <br />these projects. The final utility servicing plan tor Lot 3 must be reviewed and <br />approved by the Director of Public Works prior to any permits being issued for these <br />projects. <br /> <br />9.3 Erosion Control. Prior to site grading, and betore any utility construction is <br />commenced or building permits are issued, an erosion control plan must be <br />submitted for approval, and all erosion control actions shall be implemented, <br />inspected and approved by the CITY. <br /> <br />9.4 Clean Up. The DEVELOPER shall clean dirt and debris from streets that has <br />resulted from construction work by the DEVELOPER, its agents or assigns. The <br />CITY will determine whether it is necessary to take additional measures to clean dirt <br />and debris from the streets. After 24 hours verbal notice to the developer, the CITY <br />may complete or contract to complete the clean up at the DEVELOPER'S expense. <br /> <br />9.5 Street Trees. CITY policy requires the planting ot street trees in conjunction with <br />commercial development; however, the DEVELOPER shall not be required to install <br />street trees, as the entire streetscape along Lexington Avenue and Larpenteur <br />Avenue will be redeveloped in conjunction with street reconstruction and resurfacing <br />projects over the next three years. <br /> <br />9.6 Pedestrian Walkways. CITY policy requires the installation and/or replacement ot <br />pedestrian walkways within the public right-ot-way in conjunction with commercial <br />development; however, the DEVELOPER shall not be required to install pedestrian <br />walkways within the public right-ot-way, as the entire streetscape along Lexington <br />Avenue and Larpenteur Avenue will be redeveloped in conjunction with street <br />reconstruction and resurfacing projects over the next three years. At that time, <br />pedestrian walkways will be installed and assessed to the adjacent property owners <br />as part of the overall improvement project.
