<br />8. City policy requires the placement of sidewalk adjacent to public rights-of- <br />way in conjunction with development or redevelopment of commercial <br />properties. Because of the proposed Larpentuer Avenue reconstruction, the <br />specific requirements for this development have not been finalized. <br /> <br />9. City policy required the dedication of park land or a payment in lieu of park <br />land dedication in conjunction with the platting of property for a planned unit <br />development; however, since this property is being redeveloped and no new <br />buildable parcels are being created, the dedication of park land is not <br />required. <br /> <br />4.0 PLANNING COMMISSION ACTION <br /> <br />4.1 On January 14, 1998, the Planning Commission recommended approval of the <br />concept development plan and preliminary plat for this project (7-0). As part of the <br />motion, the Planning Commission also recommended that the City Council modify <br />its policies to eliminate the payment of the deferred assessment for this project (as <br />the site is already served by water from St. Paul), eliminate the need for right-of-way <br />dedication for this project (as the dedication may impact the design of the parking <br />area, reduce the number of off-street parking spaces, and is not needed because <br />it is doubtful that Lexington Avenue will ever be widened in this location), and <br />eliminate the need for installation of sidewalk or payment in lieu thereof for this <br />project (as sidewalk will be installed in conjunction with the Larpenteur Avenue <br />reconstruction project and the Lexington Avenue resurfacing project). <br /> <br />M STAFF RECOMMENDATION <br /> <br />5.1 Based on the findings outlined in Section 4.1 of this report, staff recommends the <br />following: <br /> <br />1. Hold the required public hearing on the final plat. <br /> <br />2. Continue action on the request to provide additional time for preparation of <br />the final Planned Unit Development/Subdivision Agreement. <br /> <br />3. Provide direction to staff on the content of the Planned Unit Development/ <br />Subdivision Agreement, including treatment of the deferred assessment for <br />this project ($37,259.39 for City Project W77-14), the need to connect to City <br />of Roseville water, the need for installation of sidewalk, and the need for <br />dedication of additional right-of-way for Lexington Avenue (10 feet). <br /> <br />fJ1 SUGGESTED CITY COUNCIL ACTION <br /> <br />6.1.
