<br />_ SEP-08-97 MON 02:06 PM CITY OF FARIBAULT <br /> <br />FAX NO. 507 334 0124 <br /> <br />Subd.3, (t) <br /> <br />FARIBAULT CODE <br /> <br />(r) For any home occupation existing pril)r to the adoption of the previous ordinance <br />(dated April 8, 1986), or this ordinance shall make application for a home occupation <br />certificate, the city administrator or appointed designee, shall identify On the home <br />occupation certificate all legally existing nonconforming aspects of said home occu- <br />pation and shall make it a part of the permanent record. The application certificate <br />shall be renewable on a biannual basis, at which time shall be subject to inspection to <br />insure compliance with the Code of Ordinances. <br /> <br />(g) Home occupation~ which receive deliveries related to the operation of the home <br />occupation will be allowed up to one (1) delivery per week from a commercial supplier. <br />Such deliveries shall not restrict traffic circulation, shall not be made by vehicles <br />commonly identified as semi trailer-tractor, and must occur between 8:00 a.m. and <br />5:00 p.m. Monday through Friday. It is not the intent of this provision to limit <br />deliveries customarily made in residential areas including, but not limited to, <br />deliveries from UPS and overnight courier services. <br /> <br />(t) In the case of a home occupation which requires the use of a commercial truck, tractor, <br />van, pickup or any vehicle whatsoever required to be registered as Zl "Y".type vehicle <br />C'Y"-type vehicles are classified as any vehicle with a carrying capacity of one (1) ton <br />or more) or any trailer or other machinery capable of being trailed behind, such <br />vehicle shall be parked off-street and upon from where such home occupation is <br />conducted and shall be subject to the following conditions and restrictions: <br /> <br />(i) Engines of such commercial vehicles shall not permitted to run continuously. A <br />thirty-minute engine warm-up time shall be pennitted immediately prior to the <br />commercial vehicle leaving the premises. The thirty-minute warm-up time shall <br />also apply to any and all air handling, refrigeration, heating Or other cq\lipment <br />involving motors which may accompany or be a part of a commercial vehicle. Such <br />thirty-minute warm up time shall begin no earlier than 6:00 a.m. and end no later <br />than 10:00 p.m. <br />(in Such commercial vehicle, trailer or machinery shall be parked only upon a <br />concrete or bituminous parking area or pad which is constructed in accordance <br />with subdivision 4 of Appendix B-Zoning (Off-Street Parking). <br />(iii) Where a home occupation is registered with the City ofFaribault and in existence <br />prior to December 1. 1989, and where the property registered for the home <br />occupation i~ phY:licBlly incapable of providing for the construction of a hard- <br />surfaced, off-street parking pad in accordance with subdivision 4 of Appendix <br />B-Zoning shall be exempt from the truck tractor off. street parking require- <br />ments; provided, however, that exemption is not for more than one (1) vehicle. <br />Said property shal\ be considered physically incapable of providing for such pad <br />if insufficient room exists in the front yard area to accommodate at least one (l) <br />lane into a g:u'age or driveway area in addition to the required parking pad. <br /> <br />lu) Garage sales. a.') defined in subdivision 1. shall not be considered home occupations, <br />provided that such sales shall be limited to a total of six (6) days of operation within <br />a calendar year at any residentiallocat.ion. <br />.. <br /> <br />)p.
