<br />2.4 The existing attached accessory steel building is located on a slightly larger <br />concrete slab. The applicant would like to construct the proposed addition with the <br />same general dimensions of the concrete slab, which would allow the addition to be <br />constructed in line with the north wall of the building and one foot closer to the west <br />property line than the existing steel building. The project as proposed would <br />remove an unsightly steel structure and replace it with an addition that improved the <br />overall appearance of the property. <br /> <br />2.5 The applicant held an information meeting on Saturday, January 31,1998. No one <br />attended this meeting or called the applicant with questions. <br /> <br />2.6 Section 1005.01 (A) of the City Code requires a side yard setback of 10 feet and a <br />rear yard setback of 20 feet for a parcel in a B3 zoning district. <br /> <br />Section 1013.02 outlines the criteria and procedure for considering a variance. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />1. Section 1005.01 (A of the City Code requires a side yard setback of 10 feet <br />and a rear yard setback of 20 feet for a parcel in a B3 zoning district. The <br />existing principal structure is on the rear property line and setback 7.7 feet <br />from the side property line. The attached accessory steel structure is set <br />back four feet from the rear property line and one foot from the side property <br />line. <br /> <br />2. The location of the existing building on the property, the substandard size of <br />the parcel (11,343 square feet), the location of trees and other landscaping <br />materials on the parcel, and the interior layout of the building creates <br />practical difficulties for constructing an addition anywhere on the parcel. <br /> <br />3. The proposed variance is in harmony with the general purpose and intent of <br />the City's Comprehensive Plan and Title 10 of the City Code (Zoning). <br /> <br />4. The proposed variance, if granted, will not adversely affect the public health, <br />safety, or general welfare. <br /> <br />4.0 STAFF RECOMMENDA TION <br /> <br />4.1 Based on the findings outline in Section 3.1, staff recommends approval of the <br />request for a variance to reduce the side yard setback to zero feet and the rear yard <br />setback to zero feet for the purpose of replacing an existing 6' x 32' attached <br />accessory steel building with 7.5' x 37' addition to the principal structure at 1227 <br />Larpenteur Avenue W, with the following provisions: <br /> <br />PF#2984 - RPCA (02/11/98) - Page 2 of 3 <br />
