In order to clarify the City's position with respect to a successor's use of the property, or our client's own use which might require additional parking, please add the following to the end of this paragraph: So long as the DEVELOPER maintains its use of the property as contemplated in this Agreement, the off-street parking areas constructed in accordance with the approved site development plan (Exhibit B) shall be satisfactory to the CITY. If additional parking is needed as a result of expanded use of the property by the DEVELOPER or required as a result of a successor's business activities, DEVELOPER shall have the right to satisfy the CITY's then-current parking requirements by replacing the smaller, single family residences (referenced in paragraph 9.3) with appropriate hard surface, concrete perimeter-curbed and drained parking area, or by providing the same on a parcel or parcels adjoining the subject property. Finally, I understand that the legal will be revised with regard to the north line to accommodate the present encroachment by Schreier's neighbor's house.
