<br />Dennis Welsch <br />City of Rose vi lie <br />January 15, 1999 <br />Page 2 <br /> <br />The CITY agrees that it will not assess parcel A or parcel B for sidewalk <br />improvements in the event such improvements are ultimately completed by or <br />on behalf of the CITY, for which costs special assessments are levied or <br />assessed against the property owners for said improvements, <br /> <br />4, With respect to paragraph 9.11: It is my und~rstaIlJing that the proposed off-street parking <br />as will be shown on the site development plan will satisfy the City insofar as Charles Cabinet Company's <br />present parking needs are concerned. In order to clarify the City's position with respect to a successor's use <br />of the property, or our client's own use which might require additional parking, please add the following to <br />the end of this paragraph: <br /> <br />So long as the DEVELOPER maintains its use of the property as contemplated <br />in this Agreement, the off-street parking areas constructed in accordance with <br />the approved site development plan (Exhibit B) shall be satisfactory to the <br />CITY. If additional parking is needed as a result of expanded use of the <br />property by the DEVELOPER or required as a result of a successor's business <br />activities, DEVELOPER shall have the right to satisfy the CITY's then-current <br />parking requirements by replacing the smaller, single family residences <br />(referenced in paragraph 9.3) with appropriate hard surface, concrete <br />perimeter-curbed and drained parking area, or by providing the same on a <br />parcel or parcels adjoining the subject property. <br /> <br />Finally, I understand that the legal will be revised with regard to the north line to accommodate the present <br />encroachment by Schreier's neighbor's house. <br /> <br />Thank: you for your consideration oftills matters, If you have any questions or need further clarification, please <br />do not hesitate to call me. <br /> <br />Respectfully, <br /> <br />/--- ~ <br /> <br />~ <br /> <br />Karl 1.
