<br />REQUEST FOR CITY COUNCIL ACTION <br />DATE: 04/27/98 <br />ITEM NO: 1-3 <br />Agenda Section: <br />LAND USE <br />Miniapple International Montessori request to amend a conditional <br />use permit to allow the expansion of a day care facility at 1875 <br />Perimeter Drive (PF#2991). <br /> <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1,1 Miniapple International Montessori is requesting an amended conditional use permit <br />to allow the expansion of a day care facility at 1875 Perimeter Drive. <br /> <br />1.2 The conditional use permit process for this request allows the City to consider <br />compatibility with adjoining properties; impacts on traffic, public facilities, and <br />property values; impact on the general health, safety, and public welfare; and <br />compatibility with the City's comprehensive plan. The process also allows the City <br />to impose those conditions it considers necessary to protect the public health, <br />safety, and welfare. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Udi and Mithula Perera own the property located at 1875 Perimeter Drive and <br />operate the Miniapple International Montessori on this property. The property is <br />located in a B-1 B Limited Retail District, and the Comprehensive Plan designates <br />the property as Business. Adjacent land uses include a variety of commercial uses <br />to the north, south, east, and west. <br /> <br />2.2 The property is currently occupied by an 3,800 square foot day care facility, which <br />was granted a conditional use permit in November 1993. The facility provides day <br />care services to children from six weeks to six years of age. The existing site has <br />a fenced play area at the front of the building (approximately 4,600 square feet). <br />The property shares a common driveway easement with its neighbor to the west <br />(Willow Gate Restaurant), with the property line being located down the center of <br />this driveway. The property also shares parking lot access easements in the rear <br />of the building with its neighbor to the east (Fairdale Shoppes). <br /> <br />2.3 The proposed expansion will include the construction of a 4,815 square foot <br />addition, which will bring the total building area to 8,615 square feet. The fenced <br />in play area in the front of the building will be reconfigured to provide six parking <br />spaces on the west side of the play area. One tree within the play area will be <br />relocated to accommodate this parking area. Other than the extension of sidewalk <br />along the west side of the addition and the placement of sod along the east side of <br />the addition, no other site improvements are proposed. <br /> <br />2.4 In conjunction with the application for a conditional use, the following documents <br /> <br />PF#2991 - RPCA (04/08/98) - Page 1 of 4 <br />
