<br />Comprehensive Plan and Title 10 of the City Code (Zoning). The <br />existing principal structure is setback 3 feet from the rear property <br />line and 4.5 feet from the side property line. The proposed addition <br />will not encroach further into these established building lines. (The <br />Planning Commission and staff received a letter opposed to <br />setback variances from James and Genevieve McCarthy, dated <br />a/5/9a, claiming that approval of the variance would damage their <br />town home property by $16,000 to $17,000 (10% of market value).) <br /> <br />2. The proposed building variances, if granted, will not adversely <br />affect the public health, safety, or general welfare. The addition will <br />be at the rear of the property in area which is now a secluded and <br />wooded area. The construction of the addition will eliminate a <br />location for youth to gather. Drainage will be directed to the front of <br />the building away from adjacent properties and construction <br />easements will be required. <br /> <br />3. The substandard size of the parcel (22,500 square feet) and the <br />location of the existing building on the parcel creates a physical <br />hardship for the applicant, not created by the applicant. The <br />interior layout of the building also presents a practical difficulty for <br />the applicant. <br /> <br />Recommendations: <br /> <br />1. The addition must be constructed of materials and sealed or painted to <br />match those used in the original building and be designed in a manner <br />conforming to the original architecture and appearance of the existing <br />building. (It may well be that the applicant repaints t~~ entire building to <br />meet this provision.) <br /> <br />2. Concrete perimeter curbing must be installed in the front parking area in <br />accordance with City requirements, as directed during the resurfacing <br />project in 19a9. <br /> <br />3. Drainage on the property must be directed to the front of the property. <br />Drainage cannot be directed to adjacent properties to the north or east. <br /> <br />4. Storm water detention an collection must be provided on site to insure that <br />the run off rate for a 10-year event does not exceed the current run off <br />rate. <br /> <br />5. Temporary construction and erosion control easements will need to be <br />obtained from/he property owners to the north and east in order to <br /> <br />3 <br />
