<br />EXCERPT FROM PLANNING COMMISSION MINUTES OF 8/12/98: <br /> <br />6b. Planning File 3036. John and Monell Jakel are requesting variances to <br />reduce the front yard setback of an accessory building to 13 feet and <br />increase the coverage of the required rear yard from 25% to 38.4% for the <br />purpose of constructing a 24' x 36' (864 sf) garage at 3170 West Owasso <br />Boulevard. <br /> <br />Chair Harms opened the public hearing and requested Dennis Welsch to present <br />a summary, based on written reports dated July 8, 1998, of the request for <br />variances. Dennis Welsch advised the purpose of the variance request was to . <br />replace an existing garage; this site had two frontages and no rear setback <br />because of the lake; the new garage would be an improvement to the site; that a <br />front yard variance would be 17', building size variance would be 301.5 square <br />feet, lot coveragewould expand to 38% instead of 25%; that sideyard setbacks <br />would be met and that topography was a big issue in the variance request. <br /> <br />Member Mulder asked if asphalt driveway would be replaced (yes with temporary <br />pavement now). <br /> <br />Member Mulder asked if the garage could be placed to the other side; Mr. Jakel <br />advised it could but this placement would block the neighbor's view of the lake. <br />An oak tree would be removed. <br /> <br />Motion: Member Mulder moved, Member Klausing seconded, to recommend <br />approval of John and Monell Jakel's request for variances to reduce the front <br />yard setback to 13 feet, to allow the placement of an accessory building in the <br />front yard area of a lakeshore parcel, and to increase the lot coverage to 38.4% <br />of the required rear yardfor the purpose of constructing a 24' x 36' (864 square <br />foot) replacement garage at 3170 West Owasso Boulevard, based on the <br />following findings: <br /> <br />1. Setion 1004.02D (4) requires a front yard setback of no less than 30 feet. <br />Because of the topography of the parcel, a garage is needed up by the <br />roadway. Meeting the 30 foot setbck requirement would require extensive <br />filling on a lakeshore lot, which would affect the drainage on this property <br />and adjacent properties. The proposed garage will be setback 13 feet <br />from the front property line. <br /> <br />2. Section 1004.01 (A) requires accessory buildings to be placed in the rear <br />yard. Since this property is a lakeshore lot, it does not have a true rear <br />yard. The roadway side of the parcel is classified as a front yard and the <br />lakeshore side of the parcel is subject to the city's shoreland setback <br />requirements. <br /> <br />3. Section 1004.01 (A) also limits the size of an accessory building to 25% of <br />
