the nonconforming structure provisions of the City Code do not allow such additions
without a variance. The proposed addition will provide a ground level bedroom and
bathroom area that will be accessible to the owner, who is physically disabled. The
addition will not increase the lot coverage above the 25% impervious surface
requirement of a shoreland area.

2.3 The request is currently being reviewed by the Minnesota Department of Natural
Resources (MnDNR). Initial comments indicate that additional screening vegetation
should be planted on the property to soften the appearance of the structure from the
lake. Additional MnDNR comment may be present at the Planning Commission
meeting.

2.3 Section 1016.16, City Code, requires a structure to be set back 75 feet from the
ordinary high water level of a general development lake.

Section 1011.02 indicates that a nonconforming structure cannot be extended,
expanded, or intensified.

Section 1013.02 outlines the procedure for considering a variance.

3.0 STAFF COMMENT

3.1 In reviewing this request, staff made the following findings:

Section 1016.16 of the City Code requires a setback of 75 feet from the ordinary
high water level of McCarrons Lake. For this reason, the existing structure
on the property is nonconforming because it is only setback 10 feet from
McCarrons Lake.

Section 1011.02 of the City Code does not allow the expansion of a non-conforming
structure, although Section 1016.22 does allow additions to non-conforming
lakeshore lots if the addition meets the setback requirements. The proposed
addition will be on the roadway side of the structure and will not reduce the
setback of the structure from the ordinary high water level of McCarrons
Lake.

The property was granted a variance from the front yard setback requirements in
1969 for the purpose of constructing the house in its current location. The
proposed addition will not extend beyond the established building setback
of 27.5 feet from the southern edge of the South McCarrons Boulevard right-
of-way.

PF3053 - RCA (08/24/98) - Page 2 of 4
