<br />the nonconforming structure provisions of the City Code do not allow such additions <br />without a variance. The proposed addition will provide a ground level bedroom and <br />bathroom area that will be accessible to the owner, who is physically disabled. The <br />addition will not increase the lot coverage above the 25% impervious surface <br />requirement of a shoreland area. <br /> <br />2.3 The request is currently being reviewed by the Minnesota Department of Natural <br />Resources (MnDNR). Initial comments indicate that additional screening vegetation <br />should be planted on the property to soften the appearance of the structure from the <br />lake. Additional MnDNR comment may be present at the Planning Commission <br />meeting. <br /> <br />2.3 Section 1016.16, City Code, requires a structure to be set back 75 feet from the <br />ordinary high water level of a general development lake. <br /> <br />Section 1011.02 indicates that a nonconforming structure cannot be extended, <br />expanded, or intensified. <br /> <br />Section 1013.02 outlines the procedure for considering a variance. <br /> <br />3.0 STAFF COMMENT <br /> <br />3.1 In reviewing this request, staff made the following findings: <br /> <br />Section 1016.16 of the City Code requires a setback of 75 feet from the ordinary <br />high water level of McCarrons Lake. For this reason, the existing structure <br />on the property is nonconforming because it is only setback 10 feet from <br />McCarrons Lake. <br /> <br />Section 1011.02 of the City Code does not allow the expansion of a non-conforming <br />structure, although Section 1016.22 does allow additions to non-conforming <br />lakeshore lots if the addition meets the setback requirements. The proposed <br />addition will be on the roadway side of the structure and will not reduce the <br />setback of the structure from the ordinary high water level of McCarrons <br />Lake. <br /> <br />The property was granted a variance from the front yard setback requirements in <br />1969 for the purpose of constructing the house in its current location. The <br />proposed addition will not extend beyond the established building setback <br />of 27.5 feet from the southern edge of the South McCarrons Boulevard right- <br />of-way. <br /> <br />PF3053 - RCA (08/24/98) - Page 2 of 4 <br />
