<br />3.4 The site is zoned "1-2" General Industrial District. Automobile, truck and trailer body repair <br />facilities are permitted uses in a "1-2" zone. Automobile repair is defmed in the zoning code <br />as: (major) general repair, rebuilding or reconditioning of engines, motor vehicles or trailers, <br />including body work, frame work and painting; and (minor) minor repairs, incidental body <br />and fender work, minor painting and upholstering service, replacement of parts and engine <br />service to passenger vehicles and trucks not exceeding % ton capacity. <br /> <br />3.5 The staff interprets the Code (Section I007.03C8 & Section I007.03Dlb) to state that new <br />and used motor vehicle sales are allowed by a dealer and that storage of inoperative <br />equipment, such as trucks and cars awaiting collision repair are allowed within an enclosed <br />structure. Further, staff interprets an enclosed structure for this use to be an opaque fence <br />which limits the view from adjoining parcels. <br /> <br />3.6 Based on the application, the use ofthis building and site shall be for activities related to the <br />storage and preparation of new vehicles and the storage and repair of inoperable vehicles. <br /> <br />3.7 Conditions may be attached (3.8 through 3.20 below) to the CUP that would mitigate the <br />impact on adjacent properties including such items as increased setbacks from property lines, <br />landscape screening, architectural color and design/materials details, impervious site <br />drainage provisions, and limiting exterior storage. <br /> <br />3.8 A drainage plan that incorporates catch basins that include grit chambers and an oil <br />catchment or skimmer shall be designed and constructed on site to alleviate off-site storrri <br />water pollution. <br /> <br />3.9 The front yard setback shall be 20 or 40 feet. Should the 20 foot setback be desirable, that <br />area shall meet the requirements of Section 1007.0IAld. The requirement to meet the ftont <br />yard setback will also eliminate the current 6.02 foot encroachment into the Partridge Road <br />right-of-way. This requirement will require a revision in the current parking lot proposal. <br /> <br />3.10 To eliminate the north side yard encroachment and to meet the side yard setback requirement, <br />the drive lanes shall maintain a five (5) foot landscaped setback separation from both the <br />north and south property line. This requirement will require a revision to proposed drive <br />lanes indicated on the current site plan. <br /> <br />3.11 To eliminate the 3.19 foot rear yard encroachment, the parking lot shall maintain a five (5) <br />foot landscape setback separation from the rear property line. This requirement will require <br />a revision to the rear parking lot and inoperable vehicle storage area. <br /> <br />3.12 In review of the submitted site plans staff assumes that the rear yard area (west) is the <br />proposed storage area for inoperable vehicles. Based on Staff s interpretation of the Code, <br />this storage area shall be screened from public view.
