LARKIN, HOFFMAN, DALY & LINDGREN, L To.

Mr. Steven R. Sarkozy
Thomas M. Scott, Esq.
May 28, 1999
Page 8

occurred on Saturday, April 10, 1999 between the hours of midnight and 6:00 a.m. The
customer transaction counts also document that the highest number of customer
transactions at the Southdale Cub Foods store generally occurs between the hours of2:00
p.m. and 7:00 p.m. on Wednesdays and 10:00 a.m. and 5:00 p.m. on Saturdays. At the
Woodbury Cub Foods store, the highest number of customer transactions generally occurs
between 4:00 p.m. and 7:00 p.m. on Wednesdays and between 11 :00 a.m. and 6:00 p.m. on
Saturdays.

. Enclosed Loading Dock and Proposed Nighttime Delivery Restriction

The proposed Cub Foods store includes four enclosed loading docks on the east side of the
building to allow easy truck access and minimize required maneuvering. The building and
loading area comply with the extraordinary 120 foot building setback and 60 foot buffer
zone requirements applicable to rear yards of a Shopping Center District that include
loading and service areas adjacent to or across the street from a residential district.

To minimize impacts from truck deliveries and to respond to neighborhood concerns,
Bradley and Cub Foods propose to prohibit truck deliveries on the Har Mar property
between the hours of 11:00 p.m. and 5:00 a.m. As described in greater detail in the "Sound
Level Assessment-Cub Foods Bar Mar Mall RosevilIe, Minnesota" prepared by David
Braslau Associates, between the hours of 5:00 a.m. and 7:00 a.m., trucks will be restricted
to a nighttime travel path pursuant to which trucks will be required to turn west at the south
end of the building and travel adjacent to the building before exiting the mall area. The
purpose of this restriction is to minimize sound level impacts on residents located south
and west of the proposed store.

. Rooftop Mechanical Equipment

Rooftop mechanical equipment will be completely screened from eye level view from
contiguous properties and adjacent streets by a four-foot high parapet wall constructed of
materials similar to and compatible with exterior materials of the principal structure. As
recommended by David Braslau and Associates, for the Har Mar store, Cub Foods will
install equipment with a fan motor speed (850 RPM) that is substantially slower than its
prototypical equipment (1150 RPM) to assure confonnance with state noise standards.
Close-in noise barriers higher than the mechanical equipment will also be used if necessary
to achieve regulatory compliance.

. Trash Handling

As required by City design standard regulations, the Cub Foods trash handling equipment
storage area will be enclosed within the principal structure on the east side of the facility
and will be of sufficient size to accommodate the separation of trash, including separate
provisions for paper, cardboard, glass, cans and miscellaneous refuse.
