D <br />W <br /> <br />REQUEST FOR CITY COUNCil <br />DISCUSSION/DIRECTION <br /> <br /> <br />DATE: 07/19/99 <br />ITEM NO: <br />A enda Section: <br /> <br />roved: <br /> <br />PRO OSALS FOR FLAG LOT ORDINANCE (PF3133) <br /> <br />1.0 BACKGROUND <br /> <br />On May 24, 1999, the Roseville City Council considered the request by Seth Eggessa regarding a <br />variance and lot split on property located at 1992 Cleveland Avenue. The City Council's action, <br />in essence, directed staff to work with the City Attorney and Mr. Eggessa to eliminate the <br />number of variances being requested for the site and to review potential impacts created by <br />flag lots. <br /> <br />2.0 ALTERNATIVES REVIEWED <br /> <br />Since the City Council's action, staff developed a list of five potential actions the City could <br />pursue. These were presented to the Council on June 26, 1999. The Council asked for further <br />work on alternative 2.2. <br /> <br />2.1 Interim Use Permit - Based on Mr. Eggessa's statements to staff, Planning <br />Commission and City Council, the City could issue an interim use permit (Section <br />1012.09) that limits the number of years the existing home is allowed to be located on the <br />subject lot. The permit could be approved for any time duration, such as 5, 7 or 10 years <br />in length and would allow the proposed structure to be constructed and the existing home <br />to be removed at the end of the permit period. Once removed the parcel would be <br />brought into conformity. <br /> <br />2.2 Flag lots - This proposal requires a text amendment to the zoning ordinance related to lot <br />size and configurations to allow creation of flag lots under certain circumstances. Staff <br />could research language from other metropolitan cities and provide the Council with a <br />draft text amendment for their consideration. Should the Council agree with the proposed <br />text amendment, staff would forward the proposed modification to the Planning <br />Commission for public hearing and recommendation. <br /> <br />2.3 Accessory Apartments - This proposal also requires research and a text amendment to <br />the zoning ordinance to allow separate apartment houses on single family residential <br />parcels under certain circumstances. Staff could research how other cities address <br />accessory apartments/homes that are utilized by a member of the principal owner family. <br /> <br />2.4 Grant a Variance - Staff can pursue modifications in the proposal presented to the <br />Council on May 24 to eliminate all variances except one for lot width on the proposed <br /> <br />PF3l33 - City Council(071999) Page I of 2 <br />
