<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: 09/27/99 <br />ITEM NO: H2 <br /> <br />Agenda Section: <br />HEARING <br /> <br />Appeal Hearing regarding the Community Development Director's <br />administrative decision regarding the granting of a setback permit for <br />property located at 2940 Old Highwav 8. (PF 3146) <br /> <br /> <br />1.0 BACKGROUND <br /> <br />1.1 Based on the City of Roseville Comprehensive Plan Housing Polices and the purposes of <br />the Setback Permit Ordinance, the setback permit procedure is to improve residential <br />quality of life, encourage reinvestment in residences and neighborhoods, improve <br />aesthetics and adapt smaller, older homes to current housing needs. <br /> <br />1.2 The City of Roseville has received its first appeal of the issuance of a Setback Permit. Upon <br />receipt of an appeal regarding the Development Review Committee's (DRC) action and the <br />Community Development Director's administrative decision, staffs procedure is to <br />expeditiously place the appeal on the next available City Council agenda and notify the <br />applicant and the individual seeking the appeal. <br /> <br />1.3 Section 11 of the July 1999 Ordinance creating the Setback Permit Procedures states: "A <br />contiguous property owner(s) may appeal the Community Development Director's <br />administrative decision regarding the granting of a setback permit by filing a written <br />appeal to the City Council with the City Manager within ten (10) days of the action <br />granting the setback permit. The City Council shall take up the appeal at a regular Council <br />meeting within thirty (30) days of the appeal. (The authority to hear appeals of an <br />administrative decision is given to the City Council acting as the City's Board of <br />Adjustment and Appeals through Minnesota Statutes 462.354) <br /> <br />1.4 The appeal is a request to review the Community Development Director's decision, not a <br />request to review a variance. No hardship finding is necessary at this stage. <br /> <br />2.0 REQUESTED ACTION <br /> <br />2.1 Kim and Todd Kaus applied for a Setback Permit to allow construction of additional living <br />space needs and an attached double stall garage. The proposal specifically proposed the <br />removal of the existing single stall garage; expanding of the existing home to include a Ih <br />bath and main floor laundry room; and replacing the single stall garage with a double stall <br />garage that is angled and includes a small work/storage area.
