<br />The northern corner ofthe proposed garage addition would lie three (3) feet eleven (11) <br />inches from the north side yard property line, an encroachment of six (6) feet one (1) inch <br />into the required 10 foot side yard setback. The actual encroachment is a triangular <br />section of the proposed attached double stall garage. (see attached limits of request) <br /> <br />3.0 DEVELOPMENT REVIEW COMMITTEE (DRe) FINDINGS & ACTION <br /> <br />3.1 The notification process requires the City to notify the adjacent/effected property owners <br />a minimum of five (5) days prior to the Setback Permit hearing. The packet of information <br />for this setback permit request was compiled in August as indicated by the memorandum <br />to DRC members and the resident letter. Planning File 3146 contains an unsigned letter <br />and extra packet dated August 23,1999. <br /> <br />3.2 This packet of information included a copy of the application, a map, narrative or <br />comments regarding the request, existing site plan, proposed site plan/floor plan, <br />elevations and notice of the September 2,1999 hearing. <br /> <br />3.3 On Thursday, September 2, the Development Review Committee held the required hearing. <br />The applicant and contractor were present as were DRC members Thomas Paschke, City <br />Planner, Doug Strong, Engineering Supervisor, Don Munson, Building Permit Coordinator, <br />and Debra Bloom, City Engineer. <br /> <br />3.4 Section 5 of the Ordinance lists 12 conditions, 8 of which have to be met in order for the <br />setback permit to be approved. The following is the DRC's determination regarding the <br />required criteria; <br /> <br />a. One car garage or less on the site. , <br /> <br />The property in question has an existing single stall attached garage on the north <br />side of the home. <br /> <br />b. The proposed project improves the design and livability of the structure. <br /> <br />The proposed project (addition of living space and a double stall garage) would <br />allow the Kaus's a garage that meets the minimum Code requirement (double stall) <br />for a single family home. The proposal also affords them additional living space <br />(laundry room and UI bath), some of which is a standard in new home <br />construction. The angular garage, entry deck, and jogs in the front facade all <br />improve the design of this home built in 1940. <br /> <br />c. The proposed project improves the terrain or a drainage issue. <br /> <br />The DRC is unaware of any terrain or drainage issues and we considered this <br />condition to be Not Applicable. <br /> <br />PF3146 - RCA (092799).doc Page 2 of 6 <br />
