<br />DEVELOPMENT REVIEW GUIDELINES & PROCEDURES <br /> <br />Comprehensive Plan Future Land Use Map, or some other elements in the Plan, it is <br />essential that a request for rezoning be supported with information to show that it is <br />consistent with the basic policy directives of the Comprehensive Plan. A change in the <br />policy plan text may also be necessary. <br /> <br />1 O. Variances: <br /> <br />The Roseville City Council serves as the Board of Zoning Variances and Appeals and <br />makes the final decision regarding zoning variances. The Roseville Code provides that <br />the City Council may approve variations from the strict and uniform application of the <br />zoning ordinance standards upon showing of undue hardship or practical difficulties. The <br />Planning Commission holds the formal hearing and recommends an action to the City <br />Council. <br /> <br />The narrative in support of a variance application should present the necessary <br />information to fully explain the "hardships" that justify the departure rrom the strict <br />application of the Code. The term "undue hardship" typically refers to physical <br />characteristics ofthe property, such as shape, soil conditions, or extreme topography. <br />Neither mere inconvenience, nor reduction in value alone, is sufficient to justify a <br />variance. The inability to put property to its highest and best use is not considered a <br />hardship or practical difficulty. The problem that justifies the variance must be caused by <br />conditions beyond the control of the applicant. The applicant cannot create the condition <br />that requires the variance. <br /> <br />11. Conditional Use Permit: <br /> <br />The Roseville Zoning Code provides for a class of uses within each zoning district, that <br />may not be acceptable generally, or without restrictions, but which may be acceptable if <br />limited as to number, intensity, and other characteristics. These uses are called <br />Conditional Uses in the Roseville Code. A formal hearing by the Planning Commission is <br />required. The Commission recommends an action to the City Council. <br /> <br />The narrative provided in support of an application for a conditional use must fully <br />describe the proposed development, with particular attention to any modifications and <br />limitations of the use that have been made to insure its compatibility with surrounding <br />uses, the purpose and intent of the zoning ordinance, and the Comprehensive Plan. <br /> <br />12. Planned Unit Development (PUD): <br /> <br />The Roseville City Code (Chapter 1008) provides the opportunity to apply for approval <br />of a rezoning to Planned Unit Development (PUD). While the approval of a rezoning <br />under other circumstances seeks either a mistake in the original zoning, or changed <br />conditions, a rezoning to PUD may be approved upon a finding that it provides for <br /> <br />Page 7 of 14 <br />
