<br />DEVELOPMENT REVIEW GUIDELINES & PROCEDURES <br /> <br />16. Rezoning Procedure: <br />(Section 1015, City Code) <br /> <br />When a proposed use is not permitted at a certain location by the code, the only way it <br />can be allowed is through a rezoning. The applicant should begin the application by <br />contacting the City Planner. The applicant must also obtain a certified list of property <br />owners within 350 feet ofthe site and two sets of mailing labels. <br /> <br />The applicant, with the assistance of the City Planner is responsible for making the <br />presentation to the Development Review Committee. The applicant should meet with the <br />City Planner to discuss the necessary submittals for project review. All of the required <br />plans and information must be submitted before the application is considered complete. <br />The completed applications must be submitted to the City no later than the designated <br />submission deadline for the Planning Commission meeting at which it is to be <br />considered. <br /> <br />The City of Roseville has developed according to a Comprehensive Plan since 1959. In <br />1959, the entire City was zoned according to the Comprehensive Plan. A new <br />Comprehensive Plan was adopted in 1994 and updated annually thereafter. Consequently, <br />requests for rezoning should be discussed in terms of their affect on the purpose and <br />intent of the Comprehensive Plan for the area, as well as their affect on the general <br />health, safety, and welfare. <br /> <br />17. Conditional Use Permit Procedure: <br />(Section 1013, City Code) <br /> <br />A conditional use is a use that would not generally be appropriate within a given zoning <br />district, but which, if controlled as to number, area, size, location, or relationship to the <br />neighborhood, could promote public health, safety, and welfare. Although the specific <br />submittals required to complete the application for a Conditional Use Permit will vary <br />with the specific use and the district in which it is located, all applicants should begin by <br />contacting the City Planner. The City Planner will refer the application to the <br />Development Review Committee. The applicant must provide a certified list of adjacent <br />property owners within 350 feet of the property and two sets of mailing labels. <br /> <br />The City Planner will become the applicant's contact with the City. All plans and <br />information required to complete the application must be submitted to the City no later <br />than the designated submittal deadline for the meeting at which it is to be considered. <br />When the planning report has been prepared, a copy will be sent to the applicant. <br />Approval of a Conditional Use Permit requires one (1) public hearing, by the Planning <br />Commission and final approval by the City Council. <br /> <br />Page 9 of 14 <br />
