Variance: <br />(Section lOn, City Code) <br /> <br />In the cases where undue hardships or practical difficulties may result from the strict <br />compliance with the performance standards contained in the Zoning Ordinance, a <br />variance may be granted. In order to recommend approval of a variance request, the <br />Planning Commission must consider the evidence presented to it and find that: <br /> <br />~ Granting the variance will not be detrimental to the public health, safety, and <br />welfare (1013.02 City Code); <br /> <br />~ The conditions upon which the request for a variance is based are unique to the <br />property for which it is sought and are not generally applicable; <br /> <br />~ The conditions that create the need for the variance are due to the particular shape, <br />topography, or other natural characteristics ofthe land and are not due to action <br />taken by the applicant; <br /> <br />~ The variance will not in any way adversely affect the purpose and intent of the <br />Comprehensive Guide Plan or Zoning Ordinance. <br /> <br />The variance procedures are intended to provide some relief from the performance <br />standards within the zoning district, such as area, location, height, or setback. They are <br />not intended, nor shall they be applied to either establish or enlarge a use that is not <br />otherwise permitted in the zoning district. <br /> <br />Applicants should begin by contacting the City Planner to discuss their proposal. The <br />City Planner will then refer the application to the Development Review Committee for <br />review, after which, the City Planner will then forward a report to the Planning <br />Commission and City Council. <br /> <br />NOTE: The submission requirements for a conditional use permit, variance, or a zoning <br />may include information required for a building permit or for a subdivision application <br />or a combination thereof, developed to portray a clear representation of the proposals. <br />The applicant should review the requirements for these applications in the Zoning Code. <br /> <br />19. Planned Unit Development Procedure: <br />(Section 1008, City Code) <br /> <br />A. Preliminary Conference: Approval of a Planned Unit Development (PUD) <br />requires presentations with the Planning Commission and with the City Council. <br />The petitioner should begin by contacting the City Planner to arrange an initial <br />meeting. At this initial meeting, the applicant will receive a copy of the <br />application and will be introduced to the City Planner who will review the project. <br /> <br />Page 10 of 14 <br />
