<br />the project and have incurred expenses to date based on this information. <br /> <br />2.2 A building permit application for the parking lot expansion and other site improvements was <br />submitted on July 2, 1997. During the review process, staff identified several additional <br />items that were needed for review prior to issuing a permit and requested the applicant to <br />provide this information including a landscaping plan, a lighting plan, stormwater runoff <br />calculations, and an explanation of how the slope would be vegetated. The last item of <br />required information was submitted by the applicant on Thursday, August 7, 1997; however, <br />a building permit has not yet been issued. <br /> <br />2.3 On Friday, August 1, 1997, City Planner Kim Lee met with neighborhood residents George <br />Tessmer and Marie Houle to discuss their concerns with the proposed project. In particular, <br />these residents were concerned about the removal of trees on the Lake Ridge property, <br />which provides a visual and sound barrier between their properties and the nursing home. <br />They also expressed concerns with the proposed slope between the property line and the <br />parking area (2H:1V). <br /> <br />2.4 On Tuesday, August 5, 1997, City Planner Kim Lee met with Todd Carsen and Dave Kotrba <br />of Lake Ridge to discuss the concerns of the residents and the City Code requirements for <br />excavation and grading. During this meeting, the representatives of Lake Ridge were <br />informed that an excavation permit was needed from the City Council if more than 5,000 <br />cubic yard of material were to be removed from the site. <br /> <br />2.4 On Tuesday, August 5, 1997, Community Development Director Dennis Welsch met with <br />George Tessmer regarding his concerns. A petition signed by 58 residents was also <br />submitted to the City on this day. The petition requests the City Council to look at the <br />proposed parking lot expansion and outlines the concerns of the neighborhood. Mr. <br />Tessmer indicated that representatives from the neighborhood will be present at the August <br />11, 1997, City Council meeting to present the petition and voice their concerns. <br /> <br />2.5 The proposed grading plan and landscaping plan was reviewed by the Ramsey County Soil <br />and Water Conservation District. <br /> <br />2.6 Section 705.018(6) of the City Code states that a permit for excavation and grading is <br />required from the City Council for any filling or excavating on developed <br />commerciallindustrial property where the site is greater than 2.5 acres and the proposed <br />fill/excavation exceeds 5,000 cubic yards. The Lake Ridge parcel is 5.6 acres in size and <br />the proposed excavation originally was 10,000 to 12,000 cubic yards. The fact that the <br />amount of material to be excavated would exceed this threshold was not known to City staff <br />until Wednesday, August 6, 1997. Section 705.03 states, "all permits required to be issued <br />by the City Council will be issued only after the appropriate notices have been sent to the <br />adjacent property owners whose land might be affected by the excavating, grading, <br />surfacing or filling, and a hearing held. The City Manager or designee will determine who <br />the affected adjacent landowners are." <br /> <br />2.7 Section 1005.011 of the City Code states, "where a business district abuts a residence <br />district, any new development shall include a buffer zone. There shall be a protective stripof <br />not less than ten feet (10') in width. This protective strip shall contain no structures, shall not <br />be used for parking, off-street loading or storage and shall be landscaped.
