<br />intended to be made pursuant to written and properly executed and <br />approved specific agreement. <br /> <br />Article II - Definitions <br /> <br />The City intends to issue a Construction Permit to the State for construction <br />improvements at the property as required to meet the State/s construction schedulel <br />provided that the State has identified all issues currently surrounding the property, <br />construction improvementsl and future use issues that will need to be addressed now <br />and possibly in the future. <br /> <br />The City has identified several current issues, which are the ponding, and <br />drainage needs for any construction improvements and the encroachment of the current <br />building, parking and signage upon city property, right-of-way used for parking without <br />formal property line setback. <br /> <br />The City has also identified an issue which may be a problem at a later date that <br />deals with the future use of the property: if the property currently shown as Parcel 2, <br />on Exhibit A, is needed for the reconstruction of Highway 36 and Snelling Avenue and if <br />the construction of a revised, expanded interchange would require Parcel 2 to be used, <br />then the parking would be substandard to meet parking needs of the property site. <br /> <br />The issues identified by the State are that the survey of the land boundary has <br />shown that the northerly three feet (approximate) of the Water1s Edge building is <br />encroaching on the City property, as is the Water's Edge sign and the northerly portion <br />of the parking lot. <br /> <br />Page 2 of3 <br />
