Regular Planning Commission Meeting <br />Minutes – Wednesday, March 5, 2014 <br />Page 11 <br />exceeded; and addressed factually and scientifically by a study not by personal <br />514 <br />perceptions. <br />515 <br />Member Murphy questioned if, as part of the deliverable product, a builder could measure <br />516 <br />lights and randomly pick points to measure to make sure they are all at the same or <br />517 <br />lesser value. <br />518 <br />Mr. Paschke responded that, to his knowledge, no such condition had ever been <br />519 <br />required. <br />520 <br />Member Boguszewski questioned if it was even necessary to suggest that the City do so, <br />521 <br />as long the body was comfortable that they had recourse to call the City’s attention to <br />522 <br />what they felt was a compliance issue and subsequently seek resolution. Member <br />523 <br />Boguszewski noted that the point was to light the field itself, and if spillover light was <br />524 <br />found to be escaping that zone, the applicant would be compelled to address the issue. <br />525 <br />Tim Callaghan <br />526 <br />Mr. Callaghan questioned if the map and lighting plan assumed that this is all level <br />527 <br />ground, opining that it was not. <br />528 <br />With concurrence of Chair Gisselquist, Member Boguszewski noted that this was not just <br />529 <br />the lighting engineers laying out something they think may happen, but was a prescribed <br />530 <br />calculation of the overall plan, including the lay of the land; and if they could not achieve <br />531 <br />the 1/10 foot candle, that responsibility was on them. <br />532 <br />Mr. Callaghan, in referencing the statement about the settling pond, opined that the <br />533 <br />parking lot line shown was moving 30’ into the settling pond area. <br />534 <br />Chair Gisselquist advised that this is something staff would review, along with watershed <br />535 <br />district staff, as the plan proceeded; noting that there remained a lot of hoops to jump <br />536 <br />through during that permitting and approval process. <br />537 <br />Mr. Callaghan stated that it was his intent to correct any misconceptions that the road <br />538 <br />was not moving, as it was doing so. <br />539 <br />Through a displayed concept plan map, Mr. Lloyd clarified that the proposed field layout <br />540 <br />and parking lane and pond are on the far side of the parking lane; cautioning that the <br />541 <br />displayed map may not be at scale as it was reduced in size to fit tonight’s display and <br />542 <br />report purposes. <br />543 <br />Mr. Callaghan disputed the distance, opining that if the distance was measured according <br />544 <br />to the map, it was longer than it used to be, and that it should be the same as the <br />545 <br />drawing. <br />546 <br />With concurrence of Chair Gisselquist, Member Boguszewski clarified again, that as <br />547 <br />plans became more detailed, and/or as the city or watershed district staff discovered any <br />548 <br />problem with the ability for that pond to function as needed, the project would not be <br />549 <br />allowed to happen, as the functionality of the pond was required and regulated to be <br />550 <br />maintained. <br />551 <br />Chair Gisselquist closed Public Hearing at approximately 8:06 p.m. <br />552 <br />MOTION <br />553 <br />Member Boguszewski moved, seconded by Member Murphy to recommend to the <br />554 <br />City Council APPROVAL of the outdoor athletic facilities and associated field <br />555 <br />lighting as a CONDITIONAL USE for the University of Northwestern at 3003 <br />556 <br />Snelling Avenue; based on the comments and findings of Sections 4-6 and the <br />557 <br />recommendation of Section 7 of the staff report dated March 5, 2014. <br />558 <br />Commissioner Position Statements <br />559 <br />Given the previously outlined recourse and process available for citizens with complaints, <br />560 <br />Member Boguszewski spoke in support of the motion. <br />561 <br /> <br />
