<br />c.Planning File 3653: Request by Arnold Rehmann for a Variance to <br />1 <br />Section 1004.01E (Pre-Existing Setback) and Section 1004.016 <br />2 <br />(Residential Dimensional Requirements –Rear Yard Setback) of the <br />3 <br />Roseville City Code to allow the construction of a living area addition <br />4 <br />(bed and bath rooms) that encroach into the 30 foot required rear yard <br />5 <br />and corner side yard setbacks for property at 44 Mid Oaks Lane. <br />6 <br /> <br />7 <br />8 Chair Bakeman opened the hearing and requested staff to provide a verbal summary of <br />9 the project report dated July 6, 2005. <br />10 <br />11 City Planner, Thomas Paschke Mr. Rehmann through his builder Brent Anderson <br />12 (Murphy Brothers), has submitted a proposal to construct a master bedroom & bathroom <br />13 addition that encroaches into the required corner side yard and rear yard setbacks <br />14 applicable to the parcel. <br />15 <br />16 The original structure (house) was built in 1948 and lies on a rectangular shaped lot that <br />17 is 150 by 80 containing 12,000 sq. ft., which lot has a maximum impervious coverage <br />18 allowance of 3,600 sq. ft (30%). The lot is considered pre-existing and non-conforming <br />19 based on its corner lot size. <br />20 <br />21 The Rehmann principal structure (house) is set back approximately 42 feet from the east <br />22 property line adjacent to Mid Oaks Lane and 22 feet from the rear (south) property line. <br />23 The proposed addition (generally extending 14 feet to the east and 10 feet to the south) <br />24 would lie 28.5 feet from the east property line and 12 feet from the south property line, <br />25 creating the need for the indicated VARIANCES. <br />26 <br />27 The proposal (an 11-1/2 foot corner side yard VARIANCE and an 18 foot rear yard <br />28 VARIANCE) will allow Mr. and Mrs. Rehmann to construct a handicapped accessible <br />29 addition and make other interior improvements, affording them the ability to stay in their <br />30 home and not seek alternative living arrangements. <br />31 <br />32 After review, the City Planner recommended approval of an 11.5 foot Variance to <br />33 Section 1004.01E (Pre-Existing Setback) and an 18 foot Variance to Section 1004.015 <br />34 (Residential Dwelling Requirements – Corner Side Yard Setback) of the Roseville City <br />35 Code to allow the construction of a 368 sq. ft. accessible living area addition on to the <br />36 southeast corner of the home, based on the findings in Section 5 and the following <br />37 conditions: <br />38 <br />39 a. The home addition shall be set back a minimum of 10 feet from the south <br />40 property line. <br />41 <br />42 b. The home addition shall be set back a minimum of 28.5 feet from the east <br />43 (corner side yard) property line which lies adjacent to Mid Oak Lane <br />44 <br />45 c. The parcel shall be limited to an impervious coverage not to exceed 30% <br />46 of the lot size or 3,600 sq. ft. <br />Page 5 of 6 <br /> <br />
