<br />4.0 STAFF COMMENTS <br /> <br />4.1 There is no other fast food restaurant within a mile of Taco Bell that can be used as an <br />example for hours of operation. The nearest fast food restaurants are located at <br />Larpenteur Avenue and Rice Street and along the Snelling Avenue Frontage Road across <br />from Har Mar Mall. Restaurants near Taco Bell all have different clientele and specific <br />hours of operation to deal with the service they provide. For example Key's Cafe & <br />Bakery is open Monday through Saturday from 6:30 a.m. to 9:00 p.m. and Sunday 7:00 <br />a.m. to 8:00 p.m; Panda Garden Buffet is open Sunday through Thursday from 11 :00 a.m. <br />to 9:00 p.m. and Friday/Saturday until 10:00 p.m.; 01' Mexico is open Monday through <br />Friday from 11 :00 a.m. to 10:00 p.m., Saturday until 11 :00 p.m., and Sunday until 9:00 <br />p.m.; the bar open until I :00 a.m.; Snuffy's Malt Shop is open Tuesday through Saturday <br />from 11 :00 a.m. to 10:00 p.m., Monday from II :00 a.m. to 9:00 p.m., and Sunday from <br />noon to 9:00 p.m.; House of Wong is open Sunday to Saturday from 11 :00 a.m. to 9:00 <br />p.m.; and St. Paul Bagelry is open from 6:30 a.m. to 6:00 p.m. Monday through Friday, <br />Saturday 6:30 to 4:00 p.m., and Sunday 7:30 to 3:00 p.m. <br /> <br />4.2 Staff is not opposed to an increase in hours of operation given Taco Bells favorable <br />police and land use record. Staff believes that the labor market and competition in the <br />area dictate whether Taco Bell will stay open until 2:00 a.m. every day of the week. <br /> <br />4.3 Currently Taco Bell closes indoor counter service at 10:00 p.m. and the drive-thru is <br />permitted to stay open until midnight on weeknights and 1 :00 a.m. on weekends. <br /> <br />4.4 In addition to the increased drive-thru hours, staff supports an annual review (for two <br />years) of hours of operation premised on the type of police responses to determine <br />whether the weekday or weekend hours should be reduced. <br /> <br />4.5 The City Code allows structures located in B-1, (Limited Business District), B-1 B <br />(Limited Retail District), and all industrial districts to have 7% of the street facade or 150 <br />square feet of wall signage. Structures located in B-2 (Retail Business District), B-3 <br />(General Business District), B-4 (Retail Office Service District), B-6 (Office Park <br />District) and SC (Shopping Center) are allowed 10% of the street facade or 200 square <br />feet whichever is greater wall area signage. <br /> <br />4.6 The language indicated in section 10.12 (signage) ofPUD #1199 allows Taco Bell 200 <br />square feet of usable sign area. The addition of a 20 square foot sign on the north facade <br />would better identify Taco Bell and the adjacent access.
