3.5 There are no City poles or private multi-tenant poles in this area of the community.

3.6 The proposed location of the monopole and supporting equipment cabinets meet the
required setback of 30 feet from property line and 50 feet from a wetland.

4.0 CONDITIONAL USE PERMIT REVIEW

4.1 Section 10B.01.D of the Roseville Zoning Ordinance lists the criteria reviewed when
considering the issuance of a conditional use permit. The criteria are as follows: impact
of parking; impact on parks, streets, and other public facilities; compatibility of site plan,
internal traffic circulation, landscaping, and structures with contiguous properties; impact
of the use on the market value of contiguous properties; impact on the general public
health, safety, and welfare; compatibility with the City's Comprehensive Plan.

4.2 Staff has reviewed the development proposal with regard to the criteria in Section
1013.01.D of the Roseville Zoning Ordinance and concludes the following:

A. The proposed antenna units and equipment cabinet will not create additional
traffic nor the need for additional public facilities.

B. The monopole and antenna units cannot be screened. However, the equipment
shelter structure can be screened. With proper screening and landscaping, the
equipment shelter will not have an impact on surrounding property or values.

C. There appears to be no impact on general health, safety, and public welfare.

D. The project complies with the Comprehensive Plan designation as a business use.

4.3 Conditions may be attached to the CUP that would mitigate the impact on adjacent
properties including such items as increased setbacks from property lines, landscape
screening, architectural color and design/materials details, drainage provisions, and
limiting additional exterior storage.

5.0 VARIANCE REVIEW & STAFF DETERMINED FINDINGS

5.1 In the case of the equipment shelter, the Code allows a maximum of200 square feet
(normally 10 feet by 20 feet). The applicant is requesting a variance to install a 240
square foot (12 foot by 20 foot) equipment shelter. Variances may be granted where the
strict enforcement of the literal provisions of the ordinance would cause "undue
hardship" .

5.2 "Undue hardship", as used in connection with the granting a variance, means the property
in question cannot be put to a reasonable use if used under conditions allowed by the
official controls; the plight of the land owner is due to circumstances unique to the
property not created by the land owner; and the variance, if granted, will not alter the
essential character of the locality.

PF3292 RCA (032601) - Page 3 of 6
