<br />. <br /> <br />. <br /> <br />. <br /> <br />REQUEST FOR CITY COUNCL ACTION <br /> <br /> <br />I>A1lE: 06/26/01 <br />I1lEM NO: <br />Agenda Section: <br />CONCENT <br /> <br /> <br />1.0 <br /> <br />Manager A roved: <br />t <br /> <br />A request by John Overbye for a 20-foot Variance from Section 703.04B1a <br />of the Roseville City Code for property located at 2916 West Owasso <br />Boulevard (PF3304) <br /> <br />REQUESTED ACTION <br /> <br />1.1 John Overbye is requesting a 20-foot variance from Section 703.04Bla of the City Code <br />to allow a driveway apron in the public right-of-way to be increased from the required <br />26- foot maximum width to a width of 46 feet. <br /> <br />2.0 BACKGROUND <br /> <br />2.1 Mr. Overbye owns the property located at 2916 West Owasso Boulevard. The property <br />is zoned R-l, Single Family Residential, and the Comprehensive Plan identifies the <br />property as Low Density Residential. <br /> <br />2.2 The City's Pavement Management Program and the reconstruction of West Owasso <br />Boulevard have prompted the variance request. <br /> <br />2.3 <br /> <br />The proposed reduction of this setback will enable Mr. Overbye to retain his driveway in <br />approximately the same location. <br /> <br />APRON WIDTH <br />Code Re uirement <br />26 feet <br /> <br /> <br />Current Width <br />46 feet <br /> <br />Variance Re uested <br />20 feet <br /> <br />A <br /> <br />3.0 STAFF COMMENT & FINDINGS <br /> <br />3.1 Section 703.04Bla requires a maximum driveway width of26 feet in a public right-of- <br />way. Based on the proposal a variance is necessary to allow the existing driveway to <br />remam. <br /> <br />3.2 Section 1013.02 requires the applicant to demonstrate a physical hardship and to <br />demonstrate that no practical alternatives exist that would reduce the need for a variance. <br /> <br />3.3 Variances may be granted where the strict enforcement of the literal provisions of the <br />ordinance would cause "undue hardship". The granting of a variance shall only occur <br />when it can be demonstrated that such an action will be in keeping with the spirit and <br />intent of the ordinance. <br /> <br />3.4 <br /> <br />"Undue hardship" as used in connection with the granting a variance means the property <br />in question cannot be put to a reasonable use ifused under conditions allowed by the <br />official controls, the plight of the land owner is due to circumstances unique to the <br />property not created by the land owner, and the variance, if granted, will not alter the <br />essential character of the locality.
