.6:

need for a 40 foot wide easement for the sanitary sewer interceptor and City
underground utilities. If vacated, the right-of-way would revert back to the adjacent
property owners on the north and south of the lona Lane right-of-way. To the north is
the Ryan Company site, presently being developed. On the south is the Old Dominion
trucking terminal site. Ryan Company's portion of the vacated right-of-way could be
used for temporary or permanent storm water ponding. There are no plans for
immediate use of the property by Old Dominion.

Staff Recommendation:

If the Comprehensive Plan is changed and the right-of-way is no longer needed for
Twin Lakes Parkway, the proposed right-of-way would not be needed for public
purposes. Therefore, staff recommends approval of a resolution to vacate the right-of-
way, subject to retention of a 40 foot easement for utility purposes.

Suggested Recommendations/Actions:

1. Recommend adoption of a resolution to vacate a portion of the unimproved,
dedicated, and City owned right-of-way of lona Lane, east of Cleveland Avenue,
subject to retention of a 40 foot utility easement.

Attachment: Resolution

Staff Report by: Rick Jopke, Assistant Community Development Director (490-2241).

2
