<br />EXTRACT OF MINUTES OF MEETING OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City Council of the City <br />ofRoseville, County of Ramsey, Minnesota, was held on the 19th day of August 2002, at <br />6:30 p.m. <br /> <br />The following members were present: <br />And the following were absent: <br /> <br />Council Member <br /> <br />introduced the following resolution and moved its adoption: <br /> <br />RESOLUTION NO. <br />A RESOLUTION APPROVING A VARIANCE TO SECTION 1012.02B2 <br />OF THE ROSEVILLE CITY CODE, TO ALLOW A SIX AND ONE-HALF FOOT <br />FENCE IN THE FRONT YARD ON PROPERTY LOCATED AT <br />1897 SHADY BEACH AVENUE NORTH (PF3383) <br /> <br />WHEREAS, Bradley Hoff, 1897 Shady Beach Avenue, has requested a variance <br />to Section 1012.02B2 of the Roseville City Code to allow for the construction ofa six <br />and one-half foot fence in the front yard (street side/east side) at his property located at <br />1897 Shady Beach Avenue No.; and, <br /> <br />WHEREAS, this property located at 1897 Shady Beach Avenue North is legally <br />described as: <br /> <br />Lot 23, Block 1, Shady Beach, Ramsey County, Minnesota (PIN#132923410018) <br /> <br />WHEREAS, Section 1012.01B2 (Front Lot Line) limits the height of a front yard <br />fence to 48 inches (four foot) maximum fence height, thereby initiating the request for a <br />two- foot variance; and <br /> <br />WHEREAS, the Planning Commission, on November 14,2001, held a public <br />hearing regarding the variance request by Mr. Hoff and voted (4-1) to recommend denial <br />of the request; and <br /> <br />WHEREAS, the City Council, at a regular meeting held on November 26, 2001, <br />approved a motion to continue the variance request for 60 days and instructed staff to <br />take this matter to Dispute Resolution Inc, and attempt to involve all affected persons; <br />and <br /> <br />WHEREAS, the City Council, at a regular meeting of April 22, 2002, approved <br />the request by Mr. Hoff for a variance to Section 1012.02B2 ofthe City Code, for a 6 ~ <br />foot fence, subject to compliance with the Mediation Agreement, including $37.58/ft. <br />reimbursement to Mr. Hoff from the City for the cost of the fence and $ 12.42/ft <br />
