by the City Council and Planning Commission.

6.0 STAFF and PLANNING COMMISSION RECOMMENDATION:

6.1 Staff recommended approval of the rezoning of the Twin Lakes Master Plan area from a mix of
Industrial (I-I, 1-2), Business (B-4, B-1) and Residential (R-l) land use zones to Mixed Use Business
Park (B-6) based on the findings in Section 4 and 5 of the project report (06/05/02).

6.2 The Planning Commission held the required hearing on the zoning map change on June 5,
2002. Four property owners spoke: Mr. Merle Goodmanson (Not aware of planning that has
gone on, concerned with traffic impacts along Fairview Avenue and possible commuter line on
rail line); Mr. Bruce Carlson (what will happen to existing properties and improvements); Mr.
Rick Jolley (how will city guarantee a compatible buffer of multi-family and landscaping along
border with Brenner Avenue); Mr. Sean Regan (concern for long term use, retail uses; and what
to do with pre-existing non-conforming truck terminals). SEE THE ATTACHED DRAFT
MINUTES FOR DETAILS.

6.3 After discussing the issue of pre-existing non-conforming uses and the long term nature of the
Twin Lakes Planning Process - estimated to be completed in 15 years - and the text of the B-6
zone which allows non-conforming uses to remain as is without expansion, the Commission
agreed that the planning of the past three years and the approval of the Comprehensive Plan
Amendment adequately set the foundation for the B-6 zoning, protected existing property
rights, and required adequate buffering. SEE THE ATTACHED DRAFT MINUTES FOR
DETAILS. A TAPE OF THE MEETING IS ALSO AVAILABLE.

6.4 The Planning Commission recommended approval (5-0) of the change on the zoning map of the
Twin Lakes Master Plan area from a mix of Industrial (I-I, 1-2), Business (B-4, B-1) and Residential
(R-l) land use zones to Mixed Use Business Park (B-6) based on the findings in Section 4 and 5
of the project report (06/05/02).

7.0 SUGGESTED ACTION

7.1 By motion, approve the amendment to the City Zoning Map by rezoning from an existing mix
of Industrial (I-I, 1-2), Business (B-4, B-1) and Residential (R-l) land use zones to Mixed Use
Business Park District (B-6) for all the parcels located within the Twin Lakes Master Plan area
as identified on the attached legal description, based on findings in Section 4 and 5 of the
project report dated June 17,2002.

Prepared by: Dennis Welsch (651-490-2232) and Cathy Bennett (651-490-2241)
Attachments: Twin Lakes Master Plan location map, aerial photo, and proposed future land use plan.
60-day Time Limit not applicable.

PF3359 - ReA 8-6 Rezone Twin Lakes (06] 702) Page 5 of 5
