<br />REQUEST FOR CITY COUNCIL ACTION <br /> <br /> <br />DATE: 04/22/02 <br />ITEM NO: VIII. B. <br />Agenda Section: <br />CONSENT <br /> <br />A request by Paul King for a Minor Subdivision (Re-combination) to modify <br />an existing property line between Lots 16 ,17,18 Garcelon's Addition, Block <br />1, 1938 Lake Street (PF3375). <br /> <br /> <br />1.0 REQUESTED ACTION <br /> <br />1.1 Mr. Paul King, property owner at 1938 Lake Street has requested the City Council <br />approval of a "Recombination" of three existing lots into two lots, one with an existing <br />house, and the remaining lot for a new home. The lots are zoned "R-l" Single Family and <br />the Comprehensive Plan designates the lots for "LDR" - Low Density Residential. <br /> <br />1.2 Section 1104.04B reads: Recombination: To divide one recorded lot or parcel in order to <br />permit the adding of a parcel of land to an abutting lot and create two (2) buildable <br />parcels, the proposed subdivision, in sketch plan form, shall be submitted to the City <br />Council for approval. No hearing or Planning Commission review is necessary unless the <br />proposal is referred to the Commission by the Community Development Director for <br />clarification. The proposed recombination shall not cause any portion of the existing lots <br />or parcels to be in violation ofthis regulation or the zoning code. Within thirty (30) days <br />after approval by the City Council, the applicant shall supply a certificate of survey to the <br />Community Development Director and City Manager for review and approval. After <br />completion of the review and approval by the Community Development Director and <br />City Manager, the applicant shall record the survey with the Ramsey County Recorder <br />within sixty (60) days after approval by the City Manager. <br /> <br />1.3 The staff suggested that the setback between the existing home and the new property line <br />be seven feet wide versus the proposed ten feet. The purpose of this lot line change is to <br />create a wider lot (65 feet wide) onto which a new home could be constructed. It should <br />be noted that the City Code allows structures in this area of Roseville to be a minimum of <br />five feet from a property line; this distance is too close on this lot with woods and steep <br />rear slopes. The staff recommended to the applicant to create a 65-foot wide parcel and an <br />85-foot wide parcel and determine the storm water pond outlet elevation. <br /> <br />1.4 The staff determined that the pond in the rear yard is a storm water pond for which any <br />structure must be set back a minimum of 20 feet. Further, any structure constructed must <br />have a lowest floor elevation a minimum of two feet above the pond outlet. <br /> <br />PF3375 ReA (042202).doc2 <br />
