3.0 pun APPROVAL The CITY hereby grants approval of the final development plan for Stoney River Development Corporation, subject to the DEVELOPER's compliance with the terms and conditions of this agreement. The CITY agrees to approve applications for building permits, provided that said plans are consistent with the exhibits listed in Section 4 below. For any improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, official controls, platting or dedication requirements enacted after the date of this Contract. 4.0 APPROVAL by the CITY In approving the Final Development Plan for the Stoney River Development Corporation Planned Unit Development, the CITY hereby incorporates the following exhibits: Exhibit A Exhibit B Exhibit C Exhibit n Exhibit E Exhibit F Exhibit G Exhibit H Certificate of Survey of the existing property including all land features, dated August 21, 2000. Site development plan that includes property boundary, building setbacks, structure location (including the trash enclosure), curbing, and parking setbacks, dated March 21, 2001. Grading plan illustrating existing grades and those proposed after completion of the proposed construction, drainage directions, spot elevations, catch basins for surface water catchment; utility plan indicating sanitary sewer, watermain, gas, electric, and storm sewer connection; and the erosion control plan, dated February 16,2001. Site lighting plan including specifications and lighting calculations for parking lot, dated March 13, 2001. Landscape plan including materials list, sizes, and locations of all plant materials, dated March 1, 2001. Building floor plan with dimensions of the facility, dated January 31, 2001. Building elevations, with dimensions and materials identified, dated January 31, 2001. Commercial condominium by-laws.
