<br /> <br />3.0 pun APPROVAL <br /> <br />The CITY hereby grants approval of the final development plan for Stoney River Development <br />Corporation, subject to the DEVELOPER's compliance with the terms and conditions of this <br />agreement. The CITY agrees to approve applications for building permits, provided that said <br />plans are consistent with the exhibits listed in Section 4 below. <br /> <br />For any improvements proposed thereafter, notwithstanding anything in this Agreement to the <br />contrary, the CITY may require compliance with any amendments to the City's Comprehensive <br />Guide Plan, official controls, platting or dedication requirements enacted after the date of this <br />Contract. <br /> <br />4.0 APPROVAL by the CITY <br /> <br />In approving the Final Development Plan for the Stoney River Development Corporation <br />Planned Unit Development, the CITY hereby incorporates the following exhibits: <br /> <br />Exhibit A <br /> <br />Exhibit B <br /> <br />Exhibit C <br /> <br />Exhibit n <br /> <br />Exhibit E <br /> <br />Exhibit F <br /> <br />Exhibit G <br /> <br />Exhibit H <br /> <br />Certificate of Survey of the existing property including all land features, <br />dated August 21, 2000. <br /> <br />Site development plan that includes property boundary, building setbacks, <br />structure location (including the trash enclosure), curbing, and parking <br />setbacks, dated March 21, 2001. <br /> <br />Grading plan illustrating existing grades and those proposed after <br />completion of the proposed construction, drainage directions, spot <br />elevations, catch basins for surface water catchment; utility plan indicating <br />sanitary sewer, watermain, gas, electric, and storm sewer connection; and <br />the erosion control plan, dated February 16,2001. <br /> <br />Site lighting plan including specifications and lighting calculations for <br />parking lot, dated March 13, 2001. <br /> <br />Landscape plan including materials list, sizes, and locations of all plant <br />materials, dated March 1, 2001. <br /> <br />Building floor plan with dimensions of the facility, dated January 31, <br />2001. <br /> <br />Building elevations, with dimensions and materials identified, dated <br />January 31, 2001. <br /> <br />Commercial condominium by-laws. <br />
