<br />upon below. Subject to a pro-rata reimbursement by Wellington, <br />Target shall be responsible for the construction of public street and <br />signals. Each Redeveloper shall be responsible for construction of <br />access driveways into their respective Development Properties. <br /> <br />, <br />The City will consider an assessment of the cost of relocation of <br />traffic signals upon the request of each Redeveloper. The City will <br />only assess those public costs upon each Redeveloper's petition <br />and waiver of public hearing and agreement to accept 100 percent <br />of the assessment cost based upon the City Assessment Policy. <br />The term and interest rate for such assessment will be determined <br />by the City Council. <br /> <br />Vacation of Rights of Way: The value of the public road and timing of rights of way and or <br />easement vacations will be determined and agreed upon by the <br />Redevelopers and the City. <br /> <br />Utilities: <br /> <br />Utility connections from public easements or rights-of-ways to <br />each building is the responsibility of each of the Redevelopers for <br />their respective Development Properties. Metropolitan Council <br />Sewer Access Connection (SAC) fees for utility connections are to <br />be paid by the Redevelopers on a pro-rata basis based on <br />. The Redevelopers are responsible <br />for compiling an inventory of all existing SAC credits. <br /> <br />Any utility relocation required as a part of the Redevelopment <br />Properties shall be the responsibility of the Redeveloper needing <br />the relocation for their construction in accordance with a Site <br />Development Agreement between Target and Wellington (the <br />"SDA") as attached hereto in Exhibit A. If the relocation is <br />necessary because of the overall redevelopment, the Redevelopers <br />shall share in the cost of such relocation in accordance with the <br />terms and conditions of the SDA. The Citv will need to review the <br />SDA and recommend attaching it to this agreement <br /> <br /> <br />Lighting: <br /> <br />Each Redeveloper is responsible for working with Xcel Energy <br />and installing a decorative street lighting plan within its portion of <br />the Development Property. A coordinated site plan will be <br />required for the entire Development Property. The street light <br />design both within the parking areas and on the street rights of way <br />must be approved as part of the PUD process and must meet City <br />standards for street lighting that requires downcast and noninvasive <br />light poles. <br /> <br />6 <br /> <br /> <br />Deleted: Fire hydrants must be installed <br />within the Development Properties after <br />the Fire Marshal.
