<br /> <br />REQUEST FOR COUNCIL ACTION <br /> <br />Department Approval: <br />DPW /TP <br />Item Description: <br /> <br />DATE: 02/09104 <br />ITEM NO: 3.6 <br /> <br />~~f iUth ~b~~~~tion: <br /> <br />Amendment to text of Board of Adjustment and Appeals City Code <br />Section 1014 (PF3538) -SECOND READING and FINAL APPRO V AL <br /> <br />1.0 BACKGROUND: <br />The review of variance cases consumes far too much time by comparison to the project <br />planning, city planning, and policy oriented activities of both the Planning Commission <br />and the City Council. Many communities are converting their variance review process <br />into a formal Board of Adjustment and Appeals. The City Council at a previous meeting <br />had asked for some input on this concept. <br /> <br />The City of White Bear Lake has used this separate Board of Adjustment and Appeals to <br />hold variance and appeal hearings for years. The Council appoints three members to the <br />Board from the Planning Commission on an annual basis. This arrangement allows for <br />the same public hearing process and notification and includes staff from the Community <br />Development Department. <br /> <br />The benefits are numerous: it is a quicker, more efficient, and specialized approach to <br />variances and appeals. The Commission and Council have more time for substantive <br />project planning, long planning, and policy issues. <br /> <br />2.0 RECOMMENDATIONS: <br />On December 3,2003, the Planning Commission held a public hearing regarding the <br />proposed changes to the City Code pertaining to the Board of Adjustment and Appeal and <br />establishment of a Variance Board. The Commission recommended approval with one <br />change - an appeal process available for applicant and/or contiguous property owners to <br />the City Council. Those changes are incorporated in the ordinance dated December 3, <br />2003 and attached. There were no additional public comments. <br /> <br />The Council reviewed the ordinance at study meeting on January 19 and held a first <br />reading on January 26, 2004. <br /> <br />3.0 SUGGESTED ACTION: <br />3.1 Hold a second reading of the ordinance.
