<br />Bloomington City Chapter 19 page 8 <br /> <br />Page 3 of 4 <br /> <br />(7) The use is consistent with the intent of the CR-1 District and with the <br />purposes of the Zoning Code as they are enumerated in Section 19.01. <br />(i) Special Provisions - <br />(1) No permits for development within the CR-1 District shall be issued by the <br />City until final site and building plans have been reviewed and approved by <br />the City Council, subject to the provisions of Section 19.40.12 of this Code. <br />(2) The City Council may waive the minimum lot size required for any use, <br />provided that the use and building is integrated, or, where adjacent property <br />is undeveloped may be shown to be reasonably integrated, by means of <br />orientation, parking, access, circulation and design with other adjacent <br />conforming development in the CR-1 District. <br />(3) Parking for each provisional or conditional use shall meet the requirements <br />of Section 19.64 of this Code for that use. <br />(4) A parking structure or the portion of any structure used for parking shall not <br />be counted as building floor area or structure coverage for the purpose of <br />calculating building floor area and percentage of site coverage by <br />structures. <br />(5) No loading docks may be on any street frontage or facing a residential <br />district, unless completely screened by a wall constructed of materials <br />equivalent to that of the structure. <br />(6) All buildings erected in the CR-1 District shall be of masonry construction, <br />an equivalent, or better. No building shall be constructed of sheet <br />aluminum, asbestos, iron, steel or corrugated metal. No buildings shall be <br />constructed with a wooden frame. Exterior surfaces of all buildings shall be <br />faced with face brick, glass, stone, architectural concrete or pre-cast <br />concrete, or an equivalent or better. Up to 15 percent of the total wall <br />surface of a building may be wood or metal used as architectural trim. <br />(7) All refuse storage shall comply with the requirements of Section 19.51 of <br />this Code. <br />(8) In instances where second-level pedestrian connections are made across <br />public streets or to adjacent properties, setbacks may be reduced to 20 feet <br />for a width not to exceed 100 feet. <br />(9) Buildings existing at the time of application of the zoning district to a <br />property which do not meet the minimum floor area requirements of this <br />Section and which are subsequently destroyed by natural causes may be <br />rebuilt to their original size. <br />(10) Structure height shall be regulated pursuant to Section 19.47 of this Code. <br />(11) Nonconformity of Use and Noncompliance of Characteristics - Except as <br />otherwise provided in Section 19.31.01(d)(5) and Section 19.31.01(i)(9) of <br />this Code, noncompliance of characteristics or features of building, parking <br />areas, and site development created by the application of the CR-1 District <br />shall not in any manner limit the legal use of the property, nor in any <br />manner limit the repair, maintenance, or reconstruction of a noncomplying <br />characteristic or feature, however, in no instance shall the degree of <br />noncompliance be increased except as otherwise permitted by this Code. <br />m Sign Regulations.
