<br />4.0 REVIEW of REQUEST: <br /> <br />4.1 Section 1004.01E (Exception) reads: "If after May 21,1959, existing houses on 50% or <br />more of the frontage of any block have a predominant front yard different from that <br />herein specified, all buildings hereafter erected shall conform to this predominant front <br />yard depth, provided this regulation shall not be interpreted so as to require a front yard <br />on more than 40 feet in depth. <br /> <br />4.2 Section 1004.02D5 (Yard Requirements - Side yard Setback) requires a minimum side <br />yard setback for a principal structure of 5 feet. <br /> <br />4.3 The Bean home lies on a block with other homes built before May 21,1959 and which <br />have varying setbacks greater that the current 30 foot front yard setback requirement. <br />Specifically, the Bean home is set back from the front yard property line approximately <br />48 feet. The property to the north of the Bean home lies approximately 46 feet from the <br />front property line and the home to the south lies approximately 44 feet from the front <br />property line. <br /> <br />4.4 Because there is no pattern in the set back differences, the Community Development <br />Department has determined that each home has its own predominant setback established <br />where the current structure lies, versus a predominant setback based on all homes on this <br />block of Dunlap Street. <br /> <br />4.5 The Bean home also lies 3 feet from the north property line, which encroaches 2 feet into <br />the required 5 foot side yard setback. <br /> <br />4.6 The Bean home is a 62 year old bungalow situated on an 11,966 square foot lot that <br />affords the property owners 3,590 square feet of impervious coverage. The proposal <br />would create 2,352 square feet of impervious coverage on the parcel, well below that <br />afforded by the City Code. <br /> <br />4.7 The current home is a small bungalow with an existing single stall attached garage that is <br />narrow and a 12 foot wide driveway, both of which present challenges for the Beans and <br />their two vehicles. The home is situated in the middle of the lot with the existing <br />attached garage located at the northwest comer of the structure, 3 feet from the north <br />property line. The home is setback 18 feet from the south property line. <br /> <br />4.8 The Bean proposal includes constructing a second story, remodeling portions of the main <br />level, including a new entrance and front porch, expanded kitchen, turning the existing <br />single attached garage stall into storage and shop area, and constructing a new 20 foot <br />wide by 24 foot deep attached garage on to the front of the home. <br /> <br />PF3459 - ReA 042803 - Page 2 of 6 <br />
