The property in question is che fonm~r Merriam Park Church of God site <br />consisting of 3.0 acres with frontage on Minnesota Avenue (134.0 feet) <br />and frontage on a cul-de-sac extending westerly from Lovell AYenue. A <br />25 foot strip was dedlcated as a part of the Church ~ite in the early 60's <br />when the Church was fir~t developed. ThlS d~dication was at the request <br />of the Fabyanske's who own property contiguous on the easterly side. <br /> <br />The property is zoned !t-l Hhereln churches are a pennitted use. <br /> <br />2. Th! Mef~ am Park Ch~rch of God has ceased operations, and proposes to sell <br />til,> '~o !rty to the Mueller-Bies Funeral Home people. The appl icants <br />pro~~__ to utilize the existing bUllding as a funeral parlor. The Rosevil:e <br />code 11 sts funera 1 homes as " Spec i a 1 Use in the 8-1 Oi strict. The <br />applicant is therefore, applying for a rezoninq of the land from R-l to <br />B-1 and approval of tne Special Use Permit for operation of the funeral home. <br />The applicant is also requesting that the 25 foot right-of-way dedicated <br />for future street be vacated. lhe application for a vacation is filed <br />Jointly by the Herriarn Park Church of God, the Kenneth R. Fabyanskets and <br />the J~mes A. Westbyt~. The Fabyanske's own the .73 acre site southeasterly <br />of the Church, the Westby's own the 0.89 acre site to the northeast of <br />the existing Church. <br /> <br />3. A reduced copy of this site plan is attached to this report. You will note <br />that the northerly portion of thlS slte is planned for two residentlal lot~ <br />to front on the Lovell Avenue cul-de-sac. He Church tf/)tlicat~d their half <br />of the cul~de-sac prior to the constructi01 of the cul~de-sac but did not <br />plat the two lots that could be platted to the south. The current applicant <br />proposes not to plat these lots at thls tlme. The 8-1 zoninq proposal would <br />begin at the south line of these lots (therefore excluding the future <br />residential lots from the rezoning). The eXlsting sinqle fami~y house on <br />the southern portion of the Church property is included in the B-1 zoning. <br />
