<br />SECTION 3. Section 1004 is hereby amended by adding the following: <br /> <br />Section 1004.11: ACCESSORY APARTMENT DWELLING: <br /> <br />Accessory apartment dwelling units shall comply with the following standards: <br /> <br />A. The accessory apartment dwelling unit shall be allowed by conditional use permit in <br />R-1 and R-2 zoning districts. Application for such a conditional use shall be made <br />pursuant to the requirements of Section 1013.01 for establishing a conditional use. <br />B. The accessory apartment shall be clearly a subordinate part of the single-family <br />dwelling. In no case shall it be more than thirty (30) percent of the building's total <br />floor area nor greater than eight hundred (800) square feet nor have more than two (2) <br />bedrooms. <br />C. The principal unit shall have at least 850 square feet ofliving space remaining after <br />creation of the accessory apartment exclusive of garage area. Accessory apartments <br />shall have at least 500 square feet of living space. Living space square footage for the <br />accessory apartment shall be exclusive of utility rooms, common hallways, entryways <br />or garages. Living space for the accessory apartment shall include a kitchen with <br />cooking facilities, a bathroom and a living room. <br />D. No front entrances shall be added to the house as a result of the accessory apartment <br />permit. <br />E. The principle structure (house) must be owner-occupied. <br />F. A minimum of three off-street parking spaces must be provided, two of which must <br />be enclosed. <br />G. The accessory apartment and principal unit must meet the applicable standards and <br />requirements of the City Code, Building Code, Ramsey County Health Codes and <br />Fire Codes. <br />H. The building and property shall remain in single ownership and title. <br />1. Only one accessory apartment permit may be issued per detached single family home. <br />J. Lot size shall be 11,000 square feet or greater. Lot coverage by impervious roofs, <br />paving, or structures shall not exceed 30%. <br /> <br />SECTION 4. Section 1004.12 is hereby amended by adding the following: <br />Section 1004.12: ACCESSORY GUEST HOUSE DWELLING: <br /> <br />Accessory guest house dwelling units shall comply with the following standards: <br /> <br />A. The accessory guest house dwelling unit shall be allowed by conditional use permit in <br />R-1 and R-2 zoning districts. Application for such a conditional use shall be made <br />pursuant to the requirements of Section 1013.01 for establishing a conditional use. <br />B. The accessory guest house dwelling unit shall be clearly a subordinate and detached <br />by more than 6 feet from the principle single-family dwelling on the site. In no case <br />shall it be more than thirty (30) percent ofthe principle building's total floor area nor <br />greater than eight hundred (800) square feet nor have more than two (2) bedrooms. <br />C. The principal structure shall have at least 850 square feet of living space exclusive of <br />garage area.
