<br />5. MATERIALS DISPOSITION <br /> <br />5.01 Disposal Facilities Must Be Specified <br /> <br />Contractor and the City shall work to maximize recycling of the <br />material collected. Contractor shall assure that all materials collected <br />at the Clean Up Day that cannot be recycled are disposed of in <br />accordance with all applicable state and federal regulations. All <br />facilities and parties handling the waste material must be licensed, <br />permitted or otherwise approved by the appropriate regulatory <br />authority. <br /> <br />Items deemed to be Municipal Solid Waste (MSW) shall be taken to <br />the Resource Recovery Facility in Newport, Minnesota. <br /> <br />Contractor shall complete Attachment B - a list of disposal facilities <br />for all the items collected specified in 3.05 and on Attachment A. <br /> <br />The City retains the right to reject a <br />facility and designate an alternate disposal facility. <br /> <br /> <br /> 5.02 Materials Disposition <br /> <br />All materials, components and residuals managed under this Proposal <br />will be restricted in international markets as follows: <br />All waste materials including processing residuals shall be processed, <br />used, reused, reclaimed or disposed of only in Canada, Mexico or the <br />United States. Additionally, the Contractor will provide <br />documentation that electronics collected are processed by a company <br />that will conduct the processing work in Mexico, Canada, or the <br />United States. Such documentation will be included in the <br /> <br /> <br />The City reserves the right, solely at the City's option, after award of <br />the Contract, to allow the management of waste materials, <br />components and/or residuals outside of Mexico, Canada, or the <br />United States. This allowance for the use, processing, reuse, <br />reclamation, or disposal of waste materials overseas will only be <br />made if the City can, at reasonable cost, assure itself of proper <br />environmental management and limited environmental risk to the <br />City. Such overseas waste management shall be by approval of <br />specific subcontractors and specific overseas locations and must be <br /> 12 <br /> <br />
