<br />4 or or <br />5 attempting to obtain, for wares, products, merchandise, other <br />6 property or services if conducted in the following manner: <br />7 a. Obstructing the free flow of either vehicular or pedestrian traffic on any street, alley, <br />8 sidewalk or other public right-of-way; <br />9 b. Conducting business in a way as to create a threat to the health, safety and welfare of <br />lO any individual or the general public; <br />11 c. Conducting business before 7:00 a.m. or after 9:00 p.m. <br />12 d. Making any false or misleading statements about the product or service being <br />13 offered, including untrue statements of endorsement; <br />14 e. Remaining on the property of another when requested to leave, or to otherwise <br />15 conduct business in a manner a reasonable person would find obscene, threatening, <br />16 intimidating or abusive. <br />17 2. Entering the property of another, unless invited to do so by the property owner or tenant, <br />18 for the purpose of conducting business as a peddler or solicitor when the property is <br />19 marked with a sign or placard at least four inches long and four inches wide with print at <br />20 least 48 point in size stating "No Trespassing" or "No Peddlers or Solicitors," or "Peddlers <br />21 and Solicitors Prohibited" or other comparable statement. Removing, defacing or <br />22 otherwise tampering with any sign or placard under this section by a person other than the <br />23 property owner or tenant. <br />24 (Ord. 1293,8-11-2003) <br />25 1. Service Stations: Operation of a business involving the sale of motor fuel and/or the repair <br />26 of motor vehicles in the following manner: <br />27 1. The use of service station premises for the sale, or for display in aid of sale, of any motor <br />28 vehicle. <br />29 2. The use of service station premises for storage of damaged or abandoned motor vehicles <br />30 for in excess of seven (7) days without a directive of the Chief of Police. <br />31 3. The storing of or the allowing of accumulation of any of the following items on service <br />32 station premises in view of adjacent land: <br />33 a. Used oil cans. <br />34 b. Discarded auto parts. <br />35 c. Discarded tires. <br />36 d. Any other items of similar debris. <br />37 4. Operating a service station with premises that does not have its entire area covered by the <br />38 following: building, concrete or bituminous paving and grass, well maintained or other well <br />39 maintained shrubbery. <br />40 5. Allowing tires to be sold or displayed for sale within view of the adjacent land unless the <br />41 same are displayed in a rack during business hours. (Ord. 499, 8-8-66; amd. 1995 Code) <br />42 J. Building Maintenance and Appearance: Buildings, fences, and other structures, which have <br />43 been so poorly maintained that their physical condition and appearance detract from the <br />44 surrounding neighborhood are declared to be public nuisances because they: 1) are <br />45 unsightly, 2) decrease adjoining landowners' and occupants enjoyment of their property and <br />46 neighborhood, and 3) adversely affect property values and neighborhood pattern. <br />47 K.
