<br /> <br /> <br />an 8 at <br />1432, l426, 1420, 1404 and 1398 Talisman Curve, and 2655 Sheldon <br />fence would be located along the new rear property line adjacent to County Road C. This <br />variance request is made on the behalf of these property owners. The new property line is <br />necessitated by the expansion of County Road C right-of-way. <br /> <br />4.2 Section 1 012.02B2 (Structures Not Considered Encroachments) states that fences in front <br />yards shall not exceed 4 feet in height. <br /> <br />4.3 All of these properties have frontage along/adjacent to 2 public streets, which for the <br />majority of parcels are considered "through lots". In the case of these parcels their <br />frontage lies along County Road C, Pascal Street, Sheldon Street and Talisman Curve. <br /> <br />4.4 Section 1004.02 (Definitions) defines a "Through Lot" as: "a lot which has a pair of <br />opposite lined along 2 substantially parallel streets and which is not a corner lot. On a <br />through lot, both street lines shall be deemed front lot lines. <br /> <br />4.5 Section 1012.02C (Fences) requires the pleasant side of the fence, that without the post, <br />to face the neighboring property or street. <br /> <br />4.6 To provide these owners with privacy and reduce the impacts of the widening of County <br />Road C, the City of Roseville and Ramsey County seek to replace the existing fences <br />(comprised of multiple designs, materials, and heights) with an 8 foot tall uniform cedar <br />fence on the new property lines adjacent to County Road C. <br /> <br />4.7 Additionally, these properties are located across the street from an active rail line, and <br />property zoned Light Industrial. Residential lots adjacent to industrial areas may be <br />screened by an 8 foot tall fence. The 8 foot tall fence would minimize impacts from the <br />rail line and industrial uses and provide each property owner with additional privacy. <br /> <br />4.8 The fences will be entirely constructed in the rear yard of most parcels, except the <br />properties at 2650 Pascal Street and 2655 Sheldon Street, which fence will be constructed <br />in the corner side yard adjacent to a street. <br /> <br />5.0 STAFF COMMENTS/FINDINGS: <br /> <br />5.1 Ramsey County is preparing plans for Phase II of the County Road C reconstruction <br />project. This project is located between Snelling Frontage Road and Oxford Street. <br />Federal funds have been allocated, and construction is scheduled to commence after <br />Phase I, Long Lake Road to Snelling Frontage Road, construction is completed.
