The subdivision of the parcel shall <br />103 <br />generally follow the common wall of the structure. <br />104 <br />c. The owner(s) of property involved in a Type 2A subdivision proposal <br />109 <br />shall file an application for approval of the subdivision by paying the fee set forth in <br />110 <br />Chapter 314 of this Code and submitting a completed application form and supporting <br />111 <br />documents as set forth on the application form. <br />112 <br />2. Complete applications shall be reviewed by the Development Review <br />113 <br />Committee (DRC) to verify that all parcels involved conform to all applicable zoning <br />114 <br />and subdivision standards and to ensure that approval of the request will not be <br />115 <br />injurious to the surrounding neighborhood and will not otherwise harm the public <br />116 <br />health, safety, and general welfare. <br />117 <br />3. Upon receiving input from the DRC, the Community Development <br />118 <br />Department shall have the authority to approve or deny the request. Alternatively, the <br />119 <br />Community Development Department may determine that an application is unusually <br />120 <br />complex and refer it to the Planning Commission for review and recommendation and <br />121 <br />to the City Council for final action. Type 2A subdivision applications shall receive <br />122 <br />final action approving or denying the request within 120 days following delivery of <br />123 <br />complete application by the applicant, unless an extension of the review period has <br />124 <br />been agreed to by the applicant, pursuant to Minn. Stat. 462.385 Subd. 3b. <br />125 <br />4. An appeal of an administrative action approving or denying a Type 2A <br />126 <br />subdivision may be filed by any property owner or their agent. <br />127 <br />a.Requirements for filing an appeal <br />128 <br />i.The appeal shall be submitted to the City Manager within 10 calendar days <br />129 <br />after the action being appealed. <br />130 <br />ii.The appeal shall state the specific grounds upon which the appeal is made. <br />131 <br />iii.The appeal shall be accompanied by the fee set forth in Chapter 314 of this <br />132 <br />Code. <br />133 <br />Page 4 of 13 <br /> <br />
