Attachment B <br />b.When an appeal is filed, a public meeting regarding the matter shall be held <br />134 <br />before the City Council, acting as the Board of Adjustments and Appeals, at a <br />135 <br />regular meeting held within 30 days of the receipt of the appeal. The Board of <br />136 <br />Adjustments and Appeals will reconsider only the evidence that had previously <br />137 <br />been considered as part of the formal action that is the subject of the appeal. New <br />138 <br />or additional information from the appeals applicant(s) may be considered by the <br />139 <br />Board of Adjustments and Appeals at its sole discretion, if that information serves <br />140 <br />to clarify information previously considered by staff. A mailed notice of the <br />141 <br />public meeting at which the appeal is to be considered will be sent to the appeals <br />142 <br />applicant(s) as well as the owner of the subject property. <br />143 <br />E. <br />144 <br />1. The owner(s) of property involved in a Type 2B subdivision proposal <br />145 <br />shall file an application for approval of the subdivision by paying the fee set forth in <br />146 <br />Chapter 314 of this Code and submitting a completed application form and supporting <br />147 <br />documents as set forth on the application form. An application for approval of a <br />148 <br />Minor Subdivision of one or more lots or parcels shall not be accepted if said lots or <br />149 <br />parcels were themselves created by subdivision within the 10 years prior to the <br />150 <br />application. <br />151 <br />2. Complete applications shall be reviewed in a public hearing before the <br />152 <br />Planning Commission and acted upon by the City Council according to the process <br />153 <br />set forth in Chapter 108 of this Code, except that the time allowed for City Council <br />154 <br />action shall conform to Minn. Stat. §462.358 Subd. 3b. The refusal to approve a <br />155 <br />Common Wall or Minor Subdivision shall be set forth in the proceedings of the City <br />156 <br />Council and reported to the person or persons applying for such approval. If a <br />157 <br />proposed subdivision is denied, an application for substantially the same subdivision <br />158 <br />shall not be accepted within 1 year of the date of the denial. <br />159 <br />3.If the proposed subdivision is approved, the subdivider shall record said plat with the <br />160 <br />County Recorder within one year after the date of approval and prior to the issuance <br />161 <br />of any building permit; otherwise, the approval of the final plat shall be considered <br />162 <br />void. Notwithstanding time limitation, the City Council may approve extensions of <br />163 <br />the time allowed for recording a final plat approval if requested in writing by the <br />164 <br />applicant; extension requests shall be submitted to the Community Development <br />165 <br />Department and shall identify the reason(s) why the extension is necessary along with <br />166 <br />an anticipated timeline for recording. <br />167 <br />168 <br />A. The Type 3 subdivision process is intended to address the most complex <br />169 <br />subdivision proposals resulting in a plat which will further develop property consistent <br />170 <br />Page 5 of 13 <br /> <br />
