The owner of property for which a preliminary plat is proposed in 242 support of a Type 3 subdivision shall file an application for approval of the 243 preliminary plat by paying the fee set forth in Chapter 314 of this Code and 244 submitting a completed application form and supporting documents as set forth on 245 the application form. 246 b. Complete applications shall be reviewed in a public hearing before the 247 Planning Commission and acted upon by the City Council according to the 248 process set forth in Chapter 108 of this Code, except that the time allowed for 249 City Council action shall conform to Minn. Stat. §462.358 Subd. 3b. If a proposed 250 preliminary plat is denied, an application for substantially the same plat of the 251 same property shall not be accepted within 1 year of the date of the denial. 252 c. A preliminary plat approval shall be validated by the applicant 253 through the submission of an application for final plat approval within one year of 254 the date of the approval. Notwithstanding this time limitation, the City Council 255 may approve extensions of the time allowed for validation of the preliminary plat 256 approval if requested in writing by the applicant; extension requests shall be 257 submitted to the Community Development Department and shall identify the 258 reason(s) why the extension is necessary along with an anticipated timeline for 259 validation. 260 d. A preliminary plat approval shall automatically expire if the approval 261 is not validated pursuant to Subsection c. 262 2. 263 a.Pursuant to approval of a preliminary plat, the owner of property for 264 which a final plat is proposed in support of a Type 3 subdivision shall file an 265 application for approval of the final plat by paying the fee set forth in Chapter 314 266 of this Code and submitting a completed application form and supporting 267 documents as set forth on the application form. Complete applications shall be 268 administratively reviewed for conformance with the preliminary plat and 269 incorporation of all changes or modifications required by the City Council. 270 b.: The City Council shall act upon a final plat 271 application according to Minn. Stat. §462.358 Subd. 3b. The refusal to approve 272 the plat shall be set forth in the proceedings of the City Council and reported to 273 the person or persons applying for such approval. If the final plat is approved, the 274 subdivider shall record said plat with the County Recorder within one year after 275 the date of approval and prior to the issuance of any building permit; otherwise, 276 Page 8 of 13
