Attachment B <br />1. <br />241 <br />a. The owner of property for which a preliminary plat is proposed in <br />242 <br />support of a Type 3 subdivision shall file an application for approval of the <br />243 <br />preliminary plat by paying the fee set forth in Chapter 314 of this Code and <br />244 <br />submitting a completed application form and supporting documents as set forth on <br />245 <br />the application form. <br />246 <br />b. Complete applications shall be reviewed in a public hearing before the <br />247 <br />Planning Commission and acted upon by the City Council according to the <br />248 <br />process set forth in Chapter 108 of this Code, except that the time allowed for <br />249 <br />City Council action shall conform to Minn. Stat. §462.358 Subd. 3b. If a proposed <br />250 <br />preliminary plat is denied, an application for substantially the same plat of the <br />251 <br />same property shall not be accepted within 1 year of the date of the denial. <br />252 <br />c. A preliminary plat approval shall be validated by the applicant <br />253 <br />through the submission of an application for final plat approval within one year of <br />254 <br />the date of the approval. Notwithstanding this time limitation, the City Council <br />255 <br />may approve extensions of the time allowed for validation of the preliminary plat <br />256 <br />approval if requested in writing by the applicant; extension requests shall be <br />257 <br />submitted to the Community Development Department and shall identify the <br />258 <br />reason(s) why the extension is necessary along with an anticipated timeline for <br />259 <br />validation. <br />260 <br />d. A preliminary plat approval shall automatically expire if the approval <br />261 <br />is not validated pursuant to Subsection c. <br />262 <br />2. <br />263 <br />a.Pursuant to approval of a preliminary plat, the owner of property for <br />264 <br />which a final plat is proposed in support of a Type 3 subdivision shall file an <br />265 <br />application for approval of the final plat by paying the fee set forth in Chapter 314 <br />266 <br />of this Code and submitting a completed application form and supporting <br />267 <br />documents as set forth on the application form. Complete applications shall be <br />268 <br />administratively reviewed for conformance with the preliminary plat and <br />269 <br />incorporation of all changes or modifications required by the City Council. <br />270 <br />b.: The City Council shall act upon a final plat <br />271 <br />application according to Minn. Stat. §462.358 Subd. 3b. The refusal to approve <br />272 <br />the plat shall be set forth in the proceedings of the City Council and reported to <br />273 <br />the person or persons applying for such approval. If the final plat is approved, the <br />274 <br />subdivider shall record said plat with the County Recorder within one year after <br />275 <br />the date of approval and prior to the issuance of any building permit; otherwise, <br />276 <br />Page 8 of 13 <br /> <br />
