Notwithstanding this time <br />277 <br />limitation, the City Council may approve extensions of the time allowed for <br />278 <br />recording a final plat approval if requested in writing by the applicant; extension <br />279 <br />requests shall be submitted to the Community Development Department and shall <br />280 <br />identify the reason(s) why the extension is necessary along with an anticipated <br />281 <br />timeline for recording. <br />282 <br />283 <br />A.Purpose <br />284 <br />1.There may be occasions when the strict application of the standards in <br />285 <br />this Chapter or the minimum lot size requirements established in Title 10 of this Code <br />286 <br />may cause undue hardship because of unique characteristics present on the property. <br />287 <br />The variance procedure is authorized by MN Stat. 462.358, Subd. 6 and is designed to <br />288 <br />permit adjustment to the subdivision regulations where there are practical difficulties <br />289 <br />applying to a parcel of land that prevent the property from being used to the extent <br />290 <br />intended by the subdivision code. “Undue hardships” may relate to factors such as the <br />291 <br />shape, topography, vegetation, wetlands, or other such characteristics of the land, or <br />292 <br />inadequate access to direct sunlight for solar energy systems. <br />293 <br />2. Certain elective characteristics of subdivisions have been <br />294 <br />designated as conditional uses; the purpose of the conditional use review process is to <br />295 <br />ensure that proposed conditional uses will satisfy applicable standards and criteria <br />296 <br />established for the protection of the public health, safety, and general welfare. <br />297 <br />Conditional uses may be approved with conditions considered reasonable and <br />298 <br />necessary to enhance compatibility with surrounding areas. <br />299 <br />B. The owner of property on which a subdivision variance or conditional use <br />300 <br />is proposed shall file an application for approval by submitting a completed application <br />301 <br />form in conjunction with the other application materials for the subdivision in question. <br />302 <br />Subdivision variance and conditional use applications shall not necessitate additional <br />303 <br />application fees, and shall be integrated into the review process and action timeline <br />304 <br />detailed above for the pertinent subdivision type. If a proposed subdivision variance or <br />305 <br />conditional use is denied, an application for substantially the same approval shall not be <br />306 <br />accepted within one year of the date of the denial. <br />307 <br />C.Action <br />308 <br />1. The City may impose conditions in the granting of variances. A condition <br />309 <br />must be directly related to, and must bear a rough proportionality to, the impact <br />310 <br />created by the variance.
