<br />7. The paved driveway areas to the frontage road shall not be expanded beyond the <br />current size. A change in location of the driveway entrance to the frontage road <br />will require an approval of a city driveway permit from the Public Works <br />Director. <br /> <br />8. Any trash containers on the site shall be screened from view from the frontage <br />road. <br /> <br />9. Except for the truck and trailer parking and storage, no additional exterior storage <br />on the site shall be permitted. No additional commercial vehicles may be parked <br />or stored on the site. <br /> <br />10. Signage shall be non-lighted, non-flashing, non-moving, and shall not exceed 75 <br />s.L <br /> <br />11. The interim use permit shall expire on June 16,2008, unless an application is <br />submitted for a five year extension ofthe permit by March 1,2008. Upon the <br />expiration date of the initial term of the interim use permit, as established by the <br />City Council, the permit shall automatically expire without action of any kind <br />unless the permit is extended in accordance with this Section and Section 12.. <br /> <br />12. Applications for extension shall be filed 120 days prior to the expiration date of <br />the original permit, or the expiration of any extension thereof. Unless the original <br />permit was expressly declared to be nonrenewable, the interim use permit may be <br />extended for additional terms of not more than five (5) years each ifthe City <br />Council makes all of the findings set forth in this resolution at of the time of each <br />renewal. The City Council shall be the approving authority for any or all <br />extensions of the permit. The Council may refer the application for extension to <br />the Planning Commission for study and recommendations action thereon if the <br />Council determines that special problems or circumstances may exist with regard <br />to the proposed extension. There is no vested right or legal entitlement to an <br />extension and the decision on any application for extension shall be within the <br />sole discretion of the City Council. <br /> <br />13. The City Council shall, in all cases, retain continuing jurisdiction over each such <br />permit and may, at any time, either on its own initiative or in response to a <br />violation of the terms of the permit, modify or delete any conditions of the permit <br />or impose any new conditions if necessary in order to preserve the public health, <br />safety and welfare, or to prevent the creation or continuance of a public nuisance, <br />or where such action is necessary to preserve or restore any of the findings set <br />forth in this resolution. Prior to Council action on an amendment to the permit, the <br />Planning Commission shall conduct a public hearing on the proposed <br />modification to the permit conditions and notice thereof shall be given in the same <br />manner as prescribed in Section 108 and Section 1012. <br /> <br />4 <br />
