<br />d) MPCA means Minnesota Pollution Control Agency. <br /> <br />e) Treatment means those methods of neutralizing <br />contaminated soil authorized for use by the MPCA. <br /> <br />170.030. Prohibition. No contaminated soil may be <br />brought into the City for storage nor may contaminated soil <br />from outside of the city be treated or disposed of within <br />the City. <br /> <br />170.040. Permit for Treatment and DisDosal. <br />contaminated soil from a source within the City may be <br />treated and disposed of pursuant to the following procedure: <br /> <br />a) Application. Before any contaminated soil may be <br />treated and disposed of, the entity seeking to <br />treat and dispose of such contaminated soil, or <br />its agent, shall complete and submit an <br />application prepared by the City staff. <br /> <br />b) Fee. At the time of application for a permit to <br />treat and dispose of contaminated soil, the <br />applicant shall pay a non-refundable fee equal to <br />one dollar ($1.00) per cubic yard of contaminated <br />soil sought to be treated and disposed of, to <br />maximum of three hundred dollars ($300.00). In <br />the event that the staff determines that it will <br />be necessary for the City to retain an outside <br />consultant to provide technical review and <br />monitoring, the applicant for a permit shall, as a <br />condition to receiving the permit, agree in <br />writing to pay the city's cost of such outside <br />consultant. <br /> <br />c) Review. The City staff shall review the <br />application, in conjunction with the MPCA's review <br />of the proposed contaminated soil treatment and <br />disposal. Such review shall include examination, <br />investigation, and written comments by the Public <br />Works Director, community Development Director, <br />Fire Marshal, and other City department heads <br />deemed appropriate. <br /> <br />d) Notice. Notice of the City Council hearing at <br />which the permit will be considered will be given, <br />in writing, to owners of properties located within <br />three hundred fifty (350) feet of the proposed <br />site for treatment or disposal of the contaminated <br />soil. Published notice in the City's legal <br />newspaper shall also be made. Such written notice <br />and published notice shall be given at least two <br />(2) weeks before the City Council meeting at which <br />the permit application is taken up. <br />
