Any other infoirnation as directed by the Community Development Department.
(iii) PUD Preliminary Plan Review
2
3
4
5
As part of the review process far a PUD Preliminary Plan, the Community
Development Department shall generate an analysis of the proposa] against the
expectations for PUDs, and make a recommendation regarding the proposed
overlay district for Planning Commission and City Council consideration.
The ICommunity Development Department shall prepare a draft ordinance to
establish the potential overlay district to be established as a component of the
PUD Final Plan.
The Planning Commission shall hold a public hearing and consider the
application's consistency with the goals for PUDs, the PUD review criteria, and
applicable comprehensive plan goals. The Planning Commission shall make
recommendations to the City Council on the merit, needed changes, and
suggested conditions to impose on the PUD.
In approving or denying the PUD Preliminary Plan, the City Council shall make
findings on the PUD review criteria outlined in Section (A)(8).
IAs a condition of Preliminary PUD Plan approval; finalization, adoption, and
publication of an overlay district ordinance shall need to occur prior to the filing
of any future final pla.
(d) PUD Final Plan
(i) Application Deadlin
Application for a PUD Final Plan shall be submitted for approval witlin ninery (90)
days of City Council approval of the PUD Preliminary Plan unless a written request
for a time extension is submitted by the applicant and approved by the City Council.
(ii) IPUD Final Plan Submittal Requirementsl
Except as may be waived by the Community Development Department, the
following information shall constitute a complete application for PUD Final Plan.
1. All required informarion far a final plat per Chapter 1102, Section 1102.04.
2. P.11 required PUD Preliminary Plan docuinents, other than the preliminary plat,
shall be updated to incorporate and address all conditions of PUD Preliminary
Plan approvall.
Page l0 of 13
Comment [BGA36]: Here we request a
separate exhibit specifically calling out wlat
deviations are being requested, and what
benefts are bcing incorporated as a result.
It is hopcd that such an exhibit will help the
Planning Commission and Council weigh tlie
give and take being proposed by any given
PUD.

 Comment [BGA37]: The Preliminary PUD
review process would follow the standard
development review steps: staff analysis &
raport, Planning Commission public learing,
and City Council decision.
Gomment [BGA38]: As part of this step,
SfaPf (not the applicant) would pen tha iniCial
/ draft ordinance that would be needed to govern
the PUD should it be approved at Fina] PUD
Plan. The Ciry's fee schedule would need to
be amended to ensure the City was covering its
costs f'or this service.
Since we only require a draft ordinance at this
point, the document can be a rough oudine and
would not need to be complete with detail. It
shoiild, however, identify eveiything that will
be addressed by the final draft, and rovide
enough detail to ensure adequate direction can
be given on needed changes.
 Comment [BGA39]: We specifically note
that approval of a PUD Preliminary Plan must
/ bc conditioned on thc successful approval and
publishing ofthe proposed overlay distnct
prior to a final plat being filed. Because tle
`Yezoning" in this case is an overlay disCricC,
iYs important that we get the details right.
Rather than rush through the process at the
Preliminary stagc, we've set up a system that
allows for a rough draft to be critiqued, and a
\ final draft brought forward at a latcr timc.
Rezoniog will still occur prior to filing of the
final plat.
Comment [BGA40]: We are suggesting a
three month deadline for an applicant to file for
PUD Final Plan following concept plan
approval.
Comment [BGA41]: For a Shird time, Yhe
listed submittal requiremenks are quite Long,
but this again ensures staff can deem an
application incomplete if necessary while
telling the applicant specifically what is needed
at thc Final stage oY the PUD process.
[1]
i Comment [BGA42]: Ratlier than re-list
everything from PUD Preliminary Plan, we
simly statc that if if was required aS
Preliminary, it must be updated as part of the
PUD Final Plan application.
